Just finalising the application for the wifes daughter to come and join us in the uk. Can anyone give me any advise on what supporting documents to submit with regards to proving that my wife has sole custody to her daughter and that the father has never seen or wanted to see his 5yr old daughter. All the wife has is a letter wrote in Thai which is stamped and signed by the local amphur stating my wife is the only legal guardian of the child (is there more documents i can get??) and also do i need this translating to English or will Thai be acceptable?

For safety's sake, I'd have the document (I presume it's a Por Kor 14?) translated in to English. Supporting documents can help demonstrate qualification under the Immigration Rules, but you are going to have to explain in a covering letter how the documentation shows that the child qualifies. Don't leave it to the ECO to put two and two together: you've got to tell him/her how it is.

You need to demonstrate that your wife has sole responsibility for her daughter. This is not to be interpreted literally, as by the very dint of living in a separate country, someone else must have de facto day-to-day responsibility for her. Rather it has to be shown that it is your wife who takes care of your step-daughter's financial and emotional needs, and directs her life.

Thanks for that Scouse, its an interesting read.

Im afraid i have another question. Ive just been reading something on the uk visas website and it states that the applicants parent/parents must be present and settled in the uk with no time limit on there stay. My wife is on an indefinate leave to remain visa which expires Sept 2009. Does this mean i will have problems when applying for her daughters visa?

Do you mean Indefinite leave to enter (ILE) visa? Indefinite leave to remain (ILR) do not have an expiry date.

If she has ILE, then this does not expire after she initially enters the UK within its validity period. See also 14.3 - Children of parent(s) or a relative settled (or to be admitted for settlement) in the United Kingdom and how they qualify.

If she has a standard 2-year spouse visa endorsement, then see also 14.4 Children of parent(s) being admitted with a view to settlement in the United Kingdom and how they qualify.
