Hi everyone,

I live in the UK and my thai g/f has been living with me for 3 months on a fiancee visa, in 2 weeks time we r getting married. After we r married what process do we have to go through to obtain another visa?

I have heard that we both have to go down to Liverpool, Glasgow or Birmingham is this correct?

Due the her visa finishing in late November we will not be able to do the process through just sending certain forms off we will have to go down in person.

Also does she have to go through the process again of having to sit through another horrendous interview, being asked question after question about myself?

Hi Makavelli,

Following your marriage your wife should apply for leave to remain from the Home Office. The form is here. You can apply either by post or in person. Unless you are in a hurry I would apply by post as it's cheaper (£155.00 compared to £250.00 if you attend in person). However, if you do apply by post bear in mind that if your wife leaves the UK whilst the application is being considered, it will lapse. Also, she would require a visa to return to the UK.

Complete the application form and enclose with it your marriage certificate, your wife's passport, your passport, your pay slips, your bank statements and proof that your property is mortgaged/rented/owned outright. That should be sufficient to get your wife her extention. It is unlikely that the HO will ask to interview her.

The extention will be for a period of 2 years and will enable your wife to work and she will be able to travel out of the UK without having to get a visa to return. At the end of this you have to reapply to the HO for indefinite leave to remain. Do not worry that her fiancée visa may expire before the HO makes a decision on her application as providing she applies before the fiancée visa expires then it will continue to apply until such a time as the HO make their decision. Knowing the HO's propensity to lose things I would send the application and supporting documents by reorded delivery.

Thanks scouse for your information, I have just rang the HO office number and they said if I apply by post it can take upto 12 weeks for the application to go through and as I said her visa finishes in early December so they said it would be best for me to go down to one of there offices in Liverpool, Glasgow or Birmingham to make the application in person which only takes a day and then your visa is granted.

What exactly happens when I go down for this application in person?

Hi Makavelli,

Your fiancée's current visa running out is not a consideration in whether you should apply by post or in person. Providing you make the new application to the HO before the fiancée visa finishes she won't be classed as an overstayer.

Anyway, if you wish to apply in person then go to your nearest public enquiry office (Croydon, Scouseland, Brum or Glasgae) and get there as early as possible. When you arrive you take a numbered ticket and wait your turn. Once you are seen the clerk will do one of 3 things. He/she will either give the stamp there and then, ask you to return with further documentation and kick you out of the door, or call for your wife's HO file before deciding what to do. If the latter, you have to wait again whilst the file comes. A word of warning - it can take all day and in rather grotty surroundings too.

To be honest, I'd save myself £95 quid and do it by post even if you do have to wait up to 12 weeks. The money would be better off in my pocket than in the HO's.

Hi Scouse, great information mate, The reason why I am thinking of going down in person is because me and my wife to be have already booked our tickets to Thailand on the 20th December. So before this date she would need to have her visa extended, is this correct?

She aldready has a ticket of return off when she first came to England back in June but obviously that is no good anymore because it runs out on the 5th December so I have bought 2 new ones from herslef and me as we will both be returning for a holiday on the 20th December for 3 weeks then returning back to the UK.

Yes, she will need the stamp in her passport extending before you travel otherwise she will need to reapply for a visa at the embassy in BKK. Going in person is therefore better.
