Hi all.

I have had my GF here for 6 weeks now and it has been great.

I want her to stay with me permanently here in Australia and to that end am wondering if the following is the best way to go about things.

Ideally I would like her to not have to return to Thailand if that is possible and lodge a spouse visa application while she is here?

She has a three month 676 tourist visa with the following conditions:

8101

8201

8205

8503

Anyone have any idea what the chances of extending her visa would be?

In the event she does have to return, I am thinking a spouse visa, less paperwork in the long run?

To do that I need to lodge notification of intent to marry and then marry her before she goes back (will only just squeeze this in as 31 days notification of marriage is required)

She heads back to Thailand and we commence the spouse visa application process.

Is this the best way to go about things?

Any tips from those who have trodden the path before?

I know there are no certainties in this process but I guess like everyone else I am wanting the smoothest least problematic way of keeping my teeruk close by :D

The visa has an 8503 no further stay which means she would have to leave Australia and reapply for another 676 visa in Bangkok.

However it is possible in some cases to get a waiver of the 8503 condition.

It would pay to consult with a licenced migration agent or DIAC first. DIAC in Australia will be a lot more helpful than DIAC in Bangkok.

They will advise you on onshore applications and if they are possible in your case.

Hi Mate and congrats on the visit thus far.

Ok....She has the no further stay on the visa.....she has to go back unless something extreme has happened.

You can marry her while she is on the visitor visa.....but then if you apply for the spouse visa it will take about 2+ months to process after lodgement.

She can apply for a visitors visa while the spouse visa application is in process but this may cause delays in the spouse visa processing time.

She can apply for another visitor in hope that she gets the 12 month Multi entry visa next time, this allows for multiple visits of upto 3 months each trip. This will give you the opportunity to gain time together as you have to show an ongoing and genuine relationship for the spouse visa....getting married is not proof enough. As I recall you have known each other about 9 months now.

It is just part of the process that you will have to have separation time during these processes....but it is worthwhile in the end. After I married Apple here in Oz last year, we had 8 days together then a 9 month separation while I saved for the application fees and the airline tickets for her and the young fella.
