In the ''Guidance-Husbands, partners (INF4)'' and Question; How do I qualify to join partner in the UK? = You must show that. You can support yourselves and any dependants without help from public funds.

Does this requirement stand for the UK sponsor and visa holders children only OR other dependants of the uk sponsor?

The sponsor and applicant need to show that they can support themselves in the UK without recourse to public funds. This means that all the sponsor's and the applicant's financial commitments will be considered, including any financial dependants the sponsor may have in the UK.

Thank's for the information, I have now sent the details of a Visa sponsor not declaring that he has a dependant son that has to live on public funds to my MP, who in turn has sent all the documentation to the MP who deals with UK Visas, it will be interesting to see if the matter will be dealt with, and how? As it appears the Visa has been obtained using false information, so should be revoked? I know that the sponsor and visa holder are visiting Thailand in February,it will be interesting to see if it will all be 'sorted' by ten?

Witholding material facts constitutes deception and in such a situation, the visa holder can be treated as an illegal entrant and removed from the UK. Likewise, rather than treating the visa holder as an illegal entrant, his/her name can be circulated on the immigration computer and the next time s/he enters the UK the immigration officer can refuse entry. However, it is "better" if s/he is treated as an illegal entrant as this does not attract a right of appeal before removal.

That's the theory: what happens in practice may be a different matter.

I assume the person you wish to exclude from the UK has a settlement visa.

As said above, all material facts must be declared on the application form, where question 6.9.14 of VAF4 asks "Does your sponsor receive any money from public funds?". As all applications are treated with strict confidence, I wonder how you know how this couple answered to this question. It is entirely possible that they answered this question truthfully.

You say that "he has a dependant son that has to live on public funds". Who is claiming/receiving these funds?

If the son is an adult and claiming these funds in his own right, then the sponsor does not need to declare it on the application as the sponsor is not receiving the funds.

If the sponsor is receiving the funds this would in all probability not result in the application being refused. You have obviously not read through the links I previously gave you fully. 9.3 - Maintenance: General requirements says

Sponsors in the UK may themselves be in receipt of public funds. However, as long as a sponsor can show that the applicant is to be maintained without claiming additional public funds, the requirement of the Rules will have been met.

May I ask your interest in this? What have you got against this couple?

Having read through her previous posts, probably ex husband by now.

Sheila, you have obviously been hurt, and badly, but you really must try to move on. Even if you do succeeed in getting this other woman permamently excluded from the UK (highly unlikely) that wont get you your husband back.

If you feel that you are not getting enough financial support from him, then you should speak to a solicitor or citizen's advice.
