Hi all.

My wifes settlement visa was refused on 9th december last year on grounds that were totally fabricated by the ECO in bangkok.We decided to start straight away with the appeal process.Long wait since but on 28th of september this year her appeal was allowed.I have just phoned the appeals tribunal who said the home office has the right to appeal but the five days has now passed so it looks like she will be getting her visa.In the appeal we did not use legal help or even attend a hearing,just some advice from this site from the likes of Scouser etc.The appeal was done on the papers provided.

Just to let all know that a refusal at interview does not mean all is lost and dont give up on it.

First of all: well done. Secondly, telephone the appropriate Home Office Presenting Officers Unit and clarify whether they are going to seek leave to appeal (unlikely). If they are not, then ask that the determination be forwarded immediately to Bangkok. If, within two to three weeks, your wife has not heard from the UKBA section in Bangkok, then contact them yourself and ask what's happening (and offer to provide them with a copy of the determination).

The visa can only now be declined if circumstances have materially changed since the application was originally made.

Great result, well done.

I guess you'll still have to wait the full two years before being able to apply for ILR - would be nice if they'd give you credit for the last 9 months 'time served'. Wishful thinking I guess.

GOING THROUGH THE APPEAL PROCESS AT THE MOMENT FOR WIFES SISTER. congrats anyway!

What Visa did your sister in-law apply for BigSpuds?

Seems strange that they let you appeal, or there is a process for appeal, for a sister in-law.

Thanks again all,there has been no appeal from the home office so now just a matter of getting intouch with the embassy to try to get the visa in her passport.

Scouse if they let me fax the determination off to them in Bangkok how long will it take for them to contact My wife and when we go to the embassy will the visa be given on the same day.
