littlemama Posted December 13, 2008 Posted December 13, 2008 Hello everyone! I am an International student who is studying in Bangkok. I have lived in Bangkok for more than four years and I am in my last year study. I got pregnant unexpectedly, so, i married with my boyfriend who is also a foreigner in here. I am from Myanmar. Now, i am 7 and half months pregnant and I found out that i need to go back to my country and deliver my baby to be able to attach in my passport. My country has stupid laws and they do not allow Myanmar women to marry foreigners legally. I married with my husband in my church, Bangkok. However, if i will deliver in Bangkok, Myanmar embassy will not issue any paper or notice for my baby and also baby cannot be Myanmar citizen at all. I want my baby to be Myanmar citizen and attached in my passport for now due to our unstable conditons. I will take leave about 2 months from my university and go and deliver the baby in Feb: 09. I will come back to Bkk and continue my classes in March. But i found out, in Myanmar, to do passport attachment process, it will take times. I couldn't stay there for so long since my classes are here and my husband is here. So, i am wondering, baby has to be attached in my passport to enter Thailand? What requirements newborn baby need to enter Thailand with me? I am on my education, non-immigrant visa. If 7 days or 9 days newborn baby can follow the mother just with birth certificate or any certificate from Thai embassy or something like that would be so easy for me to come back and catch my classes. I can go back to Myanmar after May ( after my final exams ) to do the rest of the things. Please give me some information and suggestion. Thank you so much.

Children need to have their own passports in most countries. It has been like this for several years now. Have you checked if Myanmar allows children to be on parents passports? I doubt very much you would be able to get the child into Thailand with only a birth certificate.

I doubt very much you would be able to get the child into Thailand with only a birth certificate. Yes, in my country, some babies use different passport from parents too. But i am just worried if i make separate passport for my baby, how would i apply a visa for the baby since i am not working and just studying in here. So, i asked to my embassy and they says i can attach in my passport if i would not want to do separate visa for baby. I am not sure. If i will make a separate passport for my baby, would the baby need her own Thai visa? I am really confused for all those actually
samran Posted December 14, 2008 Posted December 14, 2008 what natoinality is the father? Maybe it would be better for your child to have the fathers nationality...
littlemama Posted December 15, 2008 Author Posted December 15, 2008 what natoinality is the father? Maybe it would be better for your child to have the fathers nationality... He is Botswanan From Botswana. We all can be Botswanan citizens later. Not now because they do not have Botswana Embassy in Thailand. Only in India and Japan for Asia region. And if my baby is Botswanan, it is quite difficult to enter Myanmar again . My hubby got Myanmar visa rejection due to Myanmar and Botswana do not have diplomatic relationship. Any more suggestion?
Mario2008 Posted December 15, 2008 Posted December 15, 2008 The baby would nees it's own visa and pemission to stay. it can qualify as your dependend if you are on an educational visa with extension to stay for 1 year. Otherwise the baby can come to Thailand with a visa and be on overstay. There is no overstay fine for children.

Otherwise the baby can come to Thailand with a visa and be on overstay. There is no overstay fine for children. I am on education visa and i could stay 1 more year. So baby can be my dependent..? if so, i'm glad to hear. Even baby has separate passport, can be as dependent? Do i need to contact the Royal Thai embassy in Yangon, Myanmar before i come back to Bkk? or ...? What do i really need to do for all paper works? Thank you so much!
Mario2008 Posted December 15, 2008 Posted December 15, 2008 Yes, separete passport can be your dependend. best is to ask for a non-immigrant visa for the child at the Thai embassy in BKK. This will allow for 3 months of stay. In the last 30 days of your childs permission to stay you can go to the immigraiton office and apply for an extension of stay for her. Look here: http://www.thaivisa.com/forum/post-a70477-.html number 2.11 is the rule applying to your child. Only need proof of relationship and that the child is living with you.
Maestro Posted December 15, 2008 Posted December 15, 2008 Yes, separete passport can be your dependend. best is to ask for a non-immigrant visa for the child at the Thai embassy in BKK… You have to get the visa for the child at the Thai embassy/consulate in Myanmar. After your arrival with the child in Thailand you can then get an annual extension for your child at your local immigration office. -- Maestro The single biggest problem in communication is the illusion that it has taken place. — George Bernard Shaw

Where is Thai embassy in Bangkok? Do you mean Thai embassy in Myanmar? or Thai immigration? I will be going back to Myanmar to deliver that child. Then i want to re-enter Thailand with baby. So, i will need bank statement, birth certificate and etc:..Right? Can i apply a visa for baby in Royal Thai embassy in Myanmar? Thank you so much for answering me whatever i want to know. I really appreciate it. Thanks for the link too.
Mario2008 Posted December 15, 2008 Posted December 15, 2008 Oops. Yes, should have been Thai Embassy in Myanmar, there you apply for the visa.

I will apply the Thai visa in Myanmar for baby right after i delivered and baby got a passport. Accordind to the 2.11 in this, http://www.thaivisa.com/forum/post-a70477-.html do i really need to show bank statement with 500, 000 baht?
Mario2008 Posted December 15, 2008 Posted December 15, 2008 No, you don't need the money in the bank. (1) The alien has obtained a temporary visa (NON-IM); (2) Proof of family relationship; and (3) In the case of spouse, the marital relationship shall be de jure (legitimate) and de facto; or (4) In the case of a child, adopted child or child of his/her spouse, the said person must not be married, must be living with the applicant, and must be less than 20 years of age; or (5) In the case of parents, there must be an account deposit with a local bank made in the name of father or mother of not less than Baht 500,000 as shown in bank account transactions for the past 3 months. For the first year, it should have that said amount in the bank account for not less than 30 days at the submitted date of the application. Number 4 counts for you, not number 5. Number 5 is if your child studies in Thailand and you want to be a dependent of the child.

You are so kind to make everything clear what i have been confused. Thank you so much!
Mario2008 Posted December 15, 2008 Posted December 15, 2008 Hope the delivery will go well. Don't forget to apply for a re-entry permit when you leave Thailand.
bina Posted December 15, 2008 Posted December 15, 2008 mario i was just reading and got confused: she is on a edu visa from myanmar husband is from botwsana and we have no idea what kind of visa he has/foreign worker/refugee/rich botswana'n on business... so there is no thai nationality for the baby so how can she get the support parent visa extension if her child isnt thai... then, what happens when her visa finishes? (just trouble shooting here actually, its her business but i am curious cause it seems that she is in a bit of limbo due to her country's idiosyncrasies.) somehow i think that anyone from myanmar and with non thai national as husband (not recognized by her home country either) might need some professional help/advice/backup... dont forget i come from a country that also create all knds of beurocratic nightmares for these situations so i've learned the hard way... best of luck , little mama, but u might really consider checking with a lawyer what your options are, perhaps the university even can help out with some pre law student checking stuff for you... your country is a bit problematic so double checking cant hurt.... bina israel edit: i understand that the visa is for her child but the visa is for a thai child supporting a parent? or for any child supporting any parent?
Mario2008 Posted December 15, 2008 Posted December 15, 2008 Bina, the answer is very simple. She applies under 2.11. That is for the family member of some one who stays in Thailand to study. She is not applying as the family member of a Thai national.
Lite Beer Posted December 15, 2008 Posted December 15, 2008 Police Order 2008. 2.11 2.11 In the case of a family member of an alien who has been permitted to stay temporarily in Thailand for study in an educational institution as set out in clauses 2.8 or 2.9 (applicable only to parents, spouse, children, adopted child or the child of his/her spouse): Permission will be granted for a period of not more than 1 year at a time. Mario2008 Posted December 15, 2008 Posted December 15, 2008 Just to clearify: OP has an extension of stay based on education. She wants to get her, soon to be born, child to stay with her. It is actualy the child's possibilities to get a visa and permission to stay we were discussing. The child would qualify under 2.11 sub 4.
alyx Posted December 16, 2008 Posted December 16, 2008 got it...thanx for clarifyiing... bina My goodness I hope everything goes fine (Mario seems to know his bit) If it were I , I sure would get the baby here The baby would be Thai and would sirtv the things out afterwards (unles it gets more complicated) I know I might sound sille but life is here for Thai passport holders than Burmese (or am I wrong?)
