January 1, 200917 yr My friend's girlfriend overstayed her student visa in the US, several years ago. They have lived together the entire time and want to be married. I don't remember which visa she says she has, I think it is the kind where she stays until her education is complete. She stopped going to school though. Will it be possible for them to get married and stay in the US? What about the consequences of her negligence; Is she looking at deportation when they try to get married? Will she ever be able to visit Thailand? Any chance of a dual citizenship? Thanks for any advice. Bob
January 1, 200917 yr She needs to leave before they apply or she will never get a resident visa. Once they see she is on an overstay it will be a huge problem. Just getting married would not be a problem but I would advise against it.

An ideal solution would be for her to return to Thailand, then the guy (an AmCit I presume) files a form I-129 for a K1 Finance Visa. Process for this would probably take six months or more, depending on where he lives. There's info for this on the www.uscis.gov www site. Note that there's no "departure control" from the U.S. so her overstay might well not be noticed by the Immigration folks. On return to Thailand would recommend that she get a new passport. Mac
