I'm Consused About The 8503 Condition On A Oz 676 Tourist Visa

Well me and my girlfriend are now together in Oz with a 3 month 676 visa. So first of all thanks for all the great info on the board.

I have been reading up on here and other places (mainly google!) about the 8503 'No further stay' Condition that was imposed on my gf's visa. My understanding of this is that she cannot apply for another visa or visa extension whilst she is still in Australia. My question is; Does this stop us or reduce our chances of getting the second tourist visa, hopefully for 1 year, or do I need to start planning for a spouse (or other) visa?? She would obviously apply for this back in Bangkok in 3 months time.

All Condition 8503 does, is that it prevents this visa holder, in this case your girlfriend, from applying for another visa whilst she remains in Australia. For example she would not be able to apply for an onshore spouse visa with Condition 8503 attached to her visa.

In answer to the second part of your question, Condition 8503 on your girlfriends current visa will not prevent her from applying for a subsequent tourist visa in Bangkok, but this will be a fresh application and she will still have to satisfy all of the criteria for the grant of a tourist visa.

Thank you very much, just what I was hoping. I was sure I had read somewhere in the past that it would prevent us from getting a second tourist visa, and the guy at the office in Bangkok pointed to the Spouse visa when questioned.

I am heading down the same path as you guys. Ive met a wonderful lady in Phuket. I wasnt looking for a relationship but just happened upon it. We are very happy and now just going thru nthe process like hundreds of other aussies over the years I imagine.

Can you tell me about the timeframe of the application for the tourist visa?

How long did it take for you and your g/f and any other readers for that matter.

Any insight would be great.

It's possible for a tourist visa to be granted almost immediately upon receipt of a valid, genuine and complete application. Most times it takes longer.

The form does ask when she is travelling, it would normally be decided in plenty of time if lodged reasonably.

A tourist visa is generally granted in 3 to 5 business days IF everything is in order, and no further information is required by DIAC. As for how long the process takes, well that is totally defendant upon how long it takes your girlfriend to obtain all the required supporting documentation that needs to be submitted with her application, and if you are supporting her application, your letter of support as well.

Thanks guys. I am fairly new to the forum so all is a big help, cheers.

I will be back over there early feb with all the paperwork you mentioned so fingers crossed, no dramas.

We are holidaying for about 15 days, some in Phuket, some in Loei and obviously we will be in BKK. Intend on submitting the app on 10th Feb so that leaves us some breathing space before I have to return to Oz for work.

If you have full time employment with tax history,it's a snap,ours was three days...The governments only really interested in your finances,and the assurity that she will leave after the holiday.If you do everything right this time(Don't overstay)you will easily get a visa again for her.

I should hit the $10,000 mark by the time I get there and I am sending her over 3000 baht each week for some eglish tuition so am hoping that will suffice.

I have been told that it looks good if the thai applicant has some reasonable funds in their bank as well.

Mate,keep all the records of money sent to her,as that will be handy in the long run if you decide to marry.The embassy was not interested in how much money my missus had saved,only the tax returns i had for the last year.My missus had no money at all.I had to send a letter from my accountant with tax returns.Mine was a little messy because she had a daughter,but it all worked out great,three days and she was able to pick it up.Oh,you may not realise it,but you can edit your posts,if you make a mistake with your spelling(Everyone does)You will see the edit button below your post.Also remember,keep records of everything you do,as the embassy want phone records,pictures,emails,EVERYTHING if you eventually marry.Best of luck :o

I have had several clients who have also had similar requests. I strongly advise again this practice. It can actually work against the applicant.

DIAC policy in relation to this issue is as follows: "Particularly in high risk caseloads, case officers should be aware that recently deposited funds may raise doubts as to whether the funds are personally owned. A savings history is considered to be better evidence of the availability of adequate funds"

If my case we got a three month visa first up and then for the second tourist visa was granted a 12month visa which didn't have a no stay clause in it.

This entitled us to apply for a permanent visa from Australia.

I am not sure if this is the case with all the 12 months tourist visas but this is what happened with us.
