Hello , , my thai wife has been here in the uk with me for nearly two years , her visa runs out in aug 2009 :D , but she is now pregenant and due at the end of july :D , she is not in work although i am, and she has not been to colledge on any english language coarse, we know that she will not pass the life in uk test , nor would i!. :o and were a bit worried about what to do :D , as the time her visa runs out is around the time our baby is due :D:P , we would appreciate any helpfull info , thanks :wai:

You've still got 7 or 8 months to take the test - give it a go, you never know. I've said it before, but you can fail the test 10 times, pass it the 11th and its stll cheaper than having to pay for another 2 year visa - which brings you to the second option.

If you can't pass the test/course requirements, apply for another 2 year FLR. If circumstances are the same you should be ok - but still if possible, I'd go for the first option.

If she has satisfied the KOL requirement, and she still has plenty of time to do so, then she applies for indefinite leave to remain.

If she hasn't then she applies for further leave to remain. This lasts for another 2 years. If she completes the KOL requirement within that time then she can apply for ILR immediately without waiting for the end of the 2 years. If she hasn't done it when the 2 years is up she applies for FLR again.

As discussed elsewhere, this requirement is not difficult, it merely requires a little bit of time and effort to study for the test or, if she is not confident enough of her English, attend a course.
