Will my Canadian marriage certificate be accepted for a married to Thai visa? Our marriage has never been registered in Thailand, but we have been married for 22 years. Last trip we bought a house and we will come 'home' in November to roost.

At the embassy it will, but if you plan on living in Thailand then have it legalised and registered in Thailand as well. Contact the Thai embassy for more details about registering the marriage in Thailand.

I believe the poster is asking if his Canadian marriage certificate will be sufficient when applying for a non-o based on marriage to a Thai or does he have to register his marriage in Thailand in order to receive the visa based upon marriage to a Thai citizen.

I am interested in this answer myself. My wife and I have been married in both our countries but not registered in Thailand...I may want to apply for a visa based upon marriage and wondered if my US marriage certificate is enough.

Yes you will have to register your marriage to get an extension of stay at immigration. You have to show your wifes house book and ID card when you apply for the extension. The house book has to show your marriage.

You will have to have your marriage cetificate translated and certified by the Misistry of Foreign Affairs.

Then take the translated copy to the Amphoe (district office) and register your marriage. They will update the house book and issue your wife a new ID.

I suggest before you travel to Thailand you get a single entry non immigrant O visa at the Thai embassy or consulate. You can get this using your Canadia marriage certificate and copy of your wifes ID card or passport photo page. Then in within the last 30 days of your 90 day permit to stay you get upon entry apply for your extension.

Hi, I married abroad 24 years ago and our marriage was never registered in Thailand. Your marriage certificate (certified) (translated into Thai - certified translation) and present those documents to the Immigration department together with the Thai documents of your wife. You got to have a bank account with at least 400,000 baht fix deposit to get a 1 year visa. Check the rules at the Immigration dept. at Swon Poo. I believe that the house you bought is under her name like mine and the registration will not change anything. If your marrige is registered in other departments you will have to sign a document saying that you have no rights on the house in case of divorse or if you decide to sale it etc. Now that she is the owner of the house she must go with the papers of the new house and apply for a new house registration, where you will not be included by law. I suggest getting the marriage properly registered to anybody.

If not there is chance that immigration would not accept your application because it was not registered. Plus by it being registered it gives you certain legal rights and protection as a husband.

It is my understanding of the law that all that is required for land/propery purchase is a statement that the money is hers.

Upon divorce both parties have to agree to the settlement before it is granted. Without it being registered you have zero rights.

When my wife wants to anything that concerns property, cars and etc. I have to sign on it.

Quite simple:

Ask in the Amphur if they will recognise the Canadian marriage certificate.

If not, while being there, get married!

In the memorandum of the Kor Ror 2 let it be described that you have been married under Canadian law for 22 years.

Ask for Kor ror 2 & 3 to keep with your paperwork.

Problem solved

OP first has to to apply for the visa, for which his Canadian marriage certificate is enough.

Once in Thailand he can have its Marriage registered at the amphur (he can also do that at the embassy or consulate in Canada, but in Thailand might be easier). His marriage is recognised by Thailand, it is just not registered in Thailand. To register it in Thailand Joe showed him the right way to do it.
