Hi all, any advice will be much appreciated..

Firstly i've read over the Non O details on the Site & would just like some clarification if poss..

I'm not married but do have a Kid with a Thai Girl & the little one is a Thai National.

Will it be a problem getting a Non O based on teh fact i'm not married to her Mum ??

I have 40k per Month coming in even though i don't have 400k in any one Bank..

Basically would just like to know if me not being married will cause a problem for obtaining this Visa even though i do have a dependent, a Thai National of 3 years old, in Thailand & also, what local Asian Consulates anyone would recommend out of Singapore, Phnom Penh, KL or Penang & if any would be beneficial in going to ??

It is possible to get an extension of stay to support your child at immigration.. Your name must be on the birth certificate. Also you should be living with the mother as a family or have sole custody of the child.

If the 40,000 bahit income is from outside the country it must be proven by a letter from your embassy. If you have income earned within the country it can be proven by tax payments and showing a work permit to prove you are working legally.

How easy it is to get the extension will depend upon which immigration office serves the area where you live.

If you want a visa you can get a non-o to visit your child. All that is needed is the birth certificate.

For a single entry visa most consulates will issue them.

Only KL and Penang will issue multiple entry visas. Both will want to see a bank book with some money in the account and/or some regular deposits.

The 40k is coming from inside Thailand, i can prove Tax Receipts etc etc ..

Penang looks like the best option in that case as i'm based on Samui & want/would prefer a Multiple Entry..

If your choice is Penang for best results I suggest you use an agent. Most positive reports have been from those that used an agent.

Yep i've read Reports saying the same thing too Joe, i've been there before actually & if my memory serves me right, i ended giving my Documents to an Indian Guy near a Swiss Hotel ??

I am in a similar situation except for as the non Thai I am the mother. My daughter is also 3 years old, born in Thailand and I live with her father who is a Thai citizen but we are not married. I have been given an 0 visa, but have been told I have to do visa runs every 90 days. I am hoping that there is another option to this as I am now expecting my second child and visa runs with a 3 year old and one on the way is not easy.

The local immigration office said that if I was married and showed documents then I would not have to do the visa runs. Does anyone know about this? Moreover, are they talking about a Thai marriage or an international marriage.

They are talking about a legal marriage, ie registration of the marriage at the district office (amphur). This marriage will be internationally recognised.

If you get married in Thailand it is recognised worldwide.

As you were told before as a lady it would be easy for you to get annual extensions if you were married.

You could get 12 months extensions to live with your Child but that is not so easy and requires money in the bank.

Where did you get that O Visa nikisue, was that in Penang also or your County of Origin ??

I still find the " Marraige Certificate " part incredible, the rules are the rules obviously but who's to say, & it does happen a lot, that the other half, the Thai Parent, isn't anywhere to be seen ??

I got my O visa in the UK. It was pretty straight forward and they didn't seem to care if I was married or not. Both myself and my Thai partner decided that our relationship was not strong enough to get married. Moreover, with family issues we are unable at this time to get married. The only downside is that I am expected to do visa runs every 90 days, which to me is ridiculous. When you think that someone can get a student visa and stay for one year without any visa runs, who has no connectiion with the country. And I am trying to raise a child, having to take her out of nursery and travel to Cambodia every 90 days to put a stamp in my passport. Along with this I am pregnant with a second child and still I don't get a break with the visa runs. Will be interesting when I am 9 months pregnant having to do a visa run......

As Light Beer said, you can get an extension of stay for one year on your non-O, thus not having to leave the country every 90 days, when you have a Thai child. It requires that you have a monthly income of 40,000 baht or have 400,000 baht on a Thai bank account.

Since you are not Thai and not marreid to the father, your child has to be legitimised by the father to become Thai. In essence the father has to declare that the child is indeed his. In Thailand this is done by registeing the birth at the amphur by the fahter himself. If someone else registers the birth, he will not be considered the fahter, even if is name is on the BC. (Anyone can be named on the BC as the father).

You have raised an interesting point about registering at the amphur. My daughter was born in Thailand and her father was present. He did not register her birth as the hospital organised the birth certificate at the Amphur for us. Her father did have to provide lots of id and personal details so I hope that this was enough. I think applying fo an extension is the best option for me. On showing an income, do you know if it is 40,00 per month in general or does it increase on the birth of a second child.

40,000 a month. No limit on how many kids.

One of her members had his child registered by the hospital instead of by himself. He now has problems because of this. So I believe at this moment the fahter has not legaliy recognised your child, meaning he is not the father in a legal sense and your child doesn't have Thai nationality.

You could try to correct this at the amphur and otherwise you have to go to court to get a ruling.
