7by7 Posted March 25, 2009 Posted March 25, 2009 There is no maximum time allowed out the UK whilst qualifying for ILR. However, when applying for ILR one will need to show that the UK is one's main and primary residence. Difficult to do if more time is spent out of it than in! I doubt that a continuous 10 week absence, whilst longer than usual, will be a problem, but it may be an idea to include a note giving the reasons for it in her ILR application when the time comes, just to be sure. Having said that, there is a maximum time allowed out of the UK in the three years prior to applying for citizenship. Namely a maximum of 270 days is allowed out of the UK during the 3 years, with no more than 90 days in the final year. (NB: 270 days in the last three years for the spouse or civil partner of a British citizen, for others it is 450 days in the last 5 years.)
