Hello my wife is on a 2 year spouse visa which is up in July this year we have an 8 month child born in the U.K my wife has now had enough and wants a divorce and to move back to Thailand and take my little boy with her as you can imagine i do not want her to take my child so what i'm asking is what options do i have available to me and what can i do????

I have spoken to the passport agency and they have told me they will put a hold on any application made in my childs name without both parents consent, but is there any thing i can do thats permanent??

any help would be gratefull

I'm sorry to hear of your troubles. Does your son have any passports yet for either country?

Also on what grounds are you wanting custody? Is your wife neglectful or abusive to the child? cause tbh when you employ a solicitor & go to court to seek cusotdy they are going to want to know on what grounds.

Call the citizens advice & also speak to a solicitor. You need much more professional advice that you will get here.

Hi in answer to your questions no my son has no passports at the moment and my wife is a very good mother, i just dont want my son to grow up living in Thailand without his father and my wife has already told me that she would leave him with her parents in Phetchabun and go work in Pattaya which is no way for him to live as then he would'nt see either parent.

As for the advice i will go and see them ASAP

Good luck, it doesn't sound like the best choice for him then to go back to Thailand. Without the passports for either country she wont be able to remove him from the UK. See the CAB they are really helpful.

But from a personal opinion, I would suggest you try to keep things as civil as possible with your wife & if possible agree a suitable custody before going to court, not only will it save you a lot of money it will save time & a lot of bad feeling in the long run for the sake of your son. :o
