I have a child with a Thai woman, but we are separated. I would like to continue to stay in Thailand to be close to my daughter.

I have been here on a tourist visa, but with all the changes I am becoming worried and also tired of doing Visa runs every 90 days.

I am under 50 and have a good income from a US business...

What are my options for a long term visa???

Any help would be great, thanks..

It seems you will need to continue visa runs every 90 days. For the extension of stay based on a Thai child you will have to take care of the child yourself, and it seems the mother does that.

Another option is an educational visa. It requires you to study at least 4 hours per week on average, for instance Thai language. Cost for a course is about 29,000 baht per year, plus 1,900 for your extensions of stay every 90 days. Have a look at the banners on top of the page for more information.

The best option you have is a multiple entry non-immigrant "O" until you reach the age of 50 (retirement extension entitlement age) when you can apply for a visa extension based on this visa.

This will mean visa runs every 90 days I am afraid until you obtain your retirement extension.

And what are the requirements for a non -immigrant "0" Visa--- I understand they only give them if your are married to a Thai or have dependents along with these other reasons.

A foreigner applies for a non-immigrant visa when he/she wants to stay or work in Thailand. This visa has several categories:

diplomatic visa (D) is for those employed by an embassy,

a business visa (:)

or a mass media visa (M) are for accredited business or press representatives,

a dependent visa (O),

an expert visa (EX) are for those performing skilled or expert work,

an investor visa (IM) is for foreigners who set-up their companies under the Board Of Investment BOI

and a study/education visa (ED) is for teachers.

Official ( F). Performance of official duties (involving the Thai government).

Capital Investment ( IM ).

Investment (with concurrence of the ministries and departments concerned). BOI ( IB ).

Investment subject to the provision of the laws on investment promotion.

(ED). Educational study or observation.

( R ). Missionary work.

( RS). Scientific research or training, or study in an educational institution in the Kingdom.

( EX). Performance of skilled or expert work.

( S). Participation in an officially recognized sports event.

Others "O". Others, including dependents and retired persons.

I myself would be "elated" to have such a Visa. But I meet none of these requirements. I could say I want to check out retirement locations, look into business opportunities, or purchase a house, but I understand these are not acceptable. What is they way to apply for this visa.

It can vary from one consulate to the next, depending on how they interpret “other”. The consular section of embassies and other government-staffed consulates mostly apply very strict requirements so as to discourage too many applications, while many honorary consulates genuinely grant it for “other” purposes, ie when no other visa type corresponds to the applicant’s purpose of the trip to Thailand. Therefore, a consulate can, within the guidelines issued by the Ministry of Foreign Affairs, use “other” to grant a visa to an applicant who will travel frequently to Thailand over a period of 12 months for the purpose of tourism or to visit friends.

I am not an attorney but I know that there are ways around this kind of case.

Have you sought out legal advise on this?

Was the child born in Thailand?

Are you married to this Thai woman?

You mentioned that you are separated, but do you support both mother and child?

As far as I see it, you a the father of a Thai National and there should be a way for you to obtain residency in Thailand.

From what I heard, in order for a foreigner to established a company in Thailand you'd need to invest about a 1 million baht or so. That's roughly 30K USD.

Each case also depends on how long you've been living and working in Thailand.

If you are getting paid from overseas then, you might need to look into finding a company to hire you locally to obtain a non - immigrant B Visa which allows you to stay in Thailand for 1 year (better than the 90 day visa run). Until you can sort things out with immigration for long term stay as father of a Thai national.

At least they can never refuse you entry on any type of visa due to your child(Thai citizen) being dependant on you.

It's no big deal leaving the country every three months if you have a good income, is it? Jump on a plane to surrounding countries.
