In preparation for my first application for Non Imm O, my wife rings Immigration, they state that now the 400,000 in the bank AND a proof of 40,000 income is now required, as I understood, it was always OR not and.... has anyone got a recent experience for this??

Have not seen any information of a rule change. Current requirements are 400k OR 40k for extension of stay based on marriage. Suspect the immigration officer has made a mistake or there has been a misunderstanding somewhere in the communication.

If you are talking about a 12 month extension based on marriage.

The requirement is 400,000 Baht in the bank OR 40,000 Baht a month income.

From the 2008 Police Order.

(6) In case of marriage with a Thai lady, the husband who is an alien must have an average annual income of not less than 40,000 baht per month or a money deposit in a local Thai bank of not less than 400,000 baht for the past 2 months for expenses within a year.

Does this 400k rule apply to those applying for a one year multiple entry visa that allows one to stay in Thailand for no more than 3 months at a time? I have never had to show money in the bank or income to get the Non O marriage visa as long it it not valid for a one year stay. I have always gotten my visas from the Thai consulates in the US which is my home country. This time however, I would like to get my Non O in Penang. Has this rule changed?

They are talking about the 1 year extension at the local immigration office which is something different then simply getting a Non O visa at one of the Thai embassies or consulates.

The rules at the various consulates and embassies around the world vary a great deal. In the US it is probably very easy to get a multiple entry Non O but not so at many of the Thai consulates in Asia. Many of them won't even issue a multiple entry Non O. The Thai Embassy in KL will for example require proof that you have 100K THB in a (Thai) bank account. I read a report recently that Penang was asking for proof of 200K THB in bank account and they seem to be more strict then the embassy in KL.
