Hi,

My contract is ending and my employer will be cancelling my work permit this week but with effect from Sunday 28th February. I plan to go to Immigration on Friday and notify them of this so they can cancel my extension of stay based on work and I can apply for a 60 day extension of stay based on marriage.

My problem is that my employer seems to think that when they cancel my work permit, this will cancel my extension of stay automatically for Immigration. I have explained my understanding that I will need a letter from them to give to Immigration saying that my employment is to be terminated as of a certain date. They are telling me that they will give this letter to the Labour Office.

I have a serious problem with this because from reading here I think I am correct. My question is am I right or not?

Also, will copies of the documents that they are going to give the Labour Office be sufficient for Immigration as proof of my employment termination? Are there any other requirements for me to satisfy for Immigration?

Finally, my Work Permit is scheduled to expire anyway on the 28th of February which is also the same day as my Extension of Stay based on work expires. Would this in itself be proof of the termination of my employment if my employer continues to believe that I don't need a letter for Immigration?

Your current permission of stay ends the same day your employment ends, so you don't need to go to immigration to cancel. Just apply for the 60 day extension, you could do that now already.

Make sure you go with the misses, household book and marriage certificate.

So I don't have to cancel my extension of stay or bring a letter from my employer? Great if that's true as will save some bother.

If I apply for the new 60 day extension of stay based on marriage, would that be effective from Friday 26th or Sunday 28th if it's granted?

I'll be bringing the missus, her ID, my passport, marriage cert, KS2 (as I just found out on another thread in this forum today - thanks).

My missus has a housebook for a house in Phrae but we rent a house in CM. Will her housebook be ok or do I need to get the landlord's book. Do I need a map to our house?

Your 60 day extension will start from the day your current permission to stay ends.

Take the rental agreement with you, as you are supposed to live at the same adress as your wife. Some immigration offices will want you to extend at the area where your wife is registered, others are more relaxed. Can't say for CM if they will give you the extension if your wife officially lives in Phrea. If not you will have to go to Nan-immigration.

Thanks for the info Mario. I'll ask the boss to go to CM Immigration and ask. In the meantime, if anybody here could tell me if CM is likely to be Yes/No, that would be super. Don't really fancy a trip to Nan if possible.

Regarding the rental agreement, that's in my name but the household bills such as TOT are in my wife's name. Would that be ok for proof of living together? She also has business cards with our address on them.

Lastly, mods, would it be ok to post the query about CM Immigration in the CM forum to tap into some local knowledge please?

Hi, MF! Actually, you are right. Your case now was used to be my situation 5 months ago. I also ended my contract and did not renew it coz my Thai husband has to move to North Thailand. 1 week before I finished my contract, I settled everything. First, I went to the labour office and returned my work permit book myself. They accepted it, but they said to me they will officially cancel it on the last date indicated on my work permit. They're nice, though. But of course, I made some copies for myself just in case there is a problem. Second, since the immigration office is quite far from my place and I am bored with so much traffic in Bangkok in a rush hour, I prefered to phone them. Then they advised me to ask a letter from my employer saying that I finished and no obligations left with them. That letter must be dated the same date indicated on my visa, or else I will be overstayed. And I did, my employer gave me the clearance letter one day before my visa expired then went to the immigration office (Cheng Wattana) the next day and experienced no hassles at all. After, immigration office (Cheng Wattana), I rushed to Nonthaburi immigration with my husband since my address was in Nonthaburi that time and secured 60 days (visit the Thai husband) visa. Of course, you should have complete documents as required.

Hurry and ask your employer again for the clearance letter, you will need it for the cancellation of your working visa.
