Dear all,

There are already several threads dealing with visa issues linked to work permit cancellations. I have however not found any answering my present problem, so any comment / advice / info would be highly appreciated...

My current situation is as below:

- i have just resigned from my current job. My effective termination date is March 24.

- I first entered Thailand on a multiple entry non immigrant O visa (my wife is thai) issued in January 2008 and valid until January 2009.

- My work permit was issued on April 2, 2008. That day, i received a non-imm reentry permit valid until May 4, 2009. i also received an extension of stay from the one stop service center for visa and work permit in Bangkok valid until May 4, 2009. this extension of stay does not indicate any type of visa.

- My work permit was renewed on April 30, 2009. That day, i received a new non-imm reentry permit valid until May 4, 2010. i also received a new extension of stay (still from the one stop service center for visa and work permit in Bangkok) valid until May 4, 2010. this extension of stay still does not indicate any type of visa.

Obviously, my extension of stay was directly connected to my employment situation and my work permit. Would it matter that i first entered Thailand on a non immigrant o visa or would my extension of stay be canceled on my termination date?

in case my extension is canceled, would it be possible for me to apply for a new non immigrant o visa from Thailand based on my marriage with a Thai citizen and on the fact we have a child with thai nationality? My family and i are anyway planning to move to Europe end of April. Would there be any visa extension that i could get without having to exit the country?

Thank you very much in advance for all your comments and advice!

Cheers,

Nick

Your extension of stay ends on 24 March, date of employment end. It makes no difference on who/how/what when the reason for extension of stay is employment.

The good news is that you can receive a 60 day extension to visit wife from Immigration.

Get letter of employment termination to take to Immigration on 24th. Have wife with you and proof of marriage/her ID card and home register available and you should be able to obtain the 60 day extension rather than the normal 7 days.

You do not say what you have but if it is a double entry Visa you exit and re enter at any border to use your second entry providing the Visa is still valid.

We need to know what it is to give more help.

Non-Immigrant visas are normally issued with either single entry (good for 90 days) or multiple entry (valid for a year), so still not sure what you have without knowing the background around issue. Not aware of Kota Bharu issuing double entry tourist visas either. Perhaps you could scan in a copy of your visa for us to look at/advise further.

I was actually requesting a multiple entry visa but it just so happened that my passport will be expiring on sept.2010 and now that the policy was changed that they also check the validity of you passport. so the consulate didn't allowed me to get a 1 year multiple non b visa that why I got double entry. do you still want me to make a copy of my visa for you to be able to check it? I am going to renew my passport before reporting for my 90 days.

I don't know what country passport you have but by law you can not enter Thailand with less than six month validity remaining on it. Thailand has made exceptions for some passports but you can not be sure. If you obtain a new passport from your Embassy you can still use a valid visa in the old passport by showing both. You need a new passport as few countries will accept your entry without six months validity.

Thank you, my main question is I can report my 90 days and enter thailand in any border so that I can use my remaining 3 months is that right, I will have my new passport before I exit and enter again in the Kingdom.

You do not "report 90 days". You exit the country and return for a new 90 day entry when using visas. If you have a new passport it should not be a problem.

Hope somebody can advise me what should I do, As I have went out of the kingdom to get my remaining 90 days non-immigrant visa(double entry visa), the immigration stamped my passport only 59 days ( my non-b supposed to be expired on Jul 5 '10) I didn't got the 60 more days of it. Does this mean that I have to apply for another non-b before the date stamped on my paassport end? Please help thank you

What kind of visa do you have? A multiple non-B OR a double entry tourist visa. Just look at the stamp, does it say non-immigrant or tourist.

I got the double entry non-immigrant

What Consulate issued you that type of visa? It is very uncommon - please look at it closely and advise exactly what is written (or post a photo of it). We do not want to make any error that could cost you time or effort.

The thai consulate in Kota Bharu issued a doule entry (non-immigrant)

Visa issued date: 06 Jan 10

Visa Expiration Date: 05 Jul 10

Type of Visa: non-immigrant (:)

No. of Entries: 2

For the last exit the immigration stamped my passport:

30 Mar 2010

admitted until 28 May 2010

The double entry non-immigrant visa is very rare, that is probably why the immigration officer took it for a tourist visa.

If it is indeed a non-immigrant double entry you should go to immigration to have the permission to stay adjusted to 90 days.

PS. Get a new passport ASAP, as yours has less than 6month on it.

I already applied for my renewal of passport but it will be release 1 month after applying, so my renewed passport will be on my hand by the end of this month. Is there any fee if will ask the immigration to adjust it for 90 days, and do I need my renewed passport when i request for it?

There is no fee and you will not need your new passport. Reminding about getting a new passport was because most countries demand at least 6 month validity when entering, so you when you leave Thailand with your old passport you basically could only travel back to your own country.

And would it be possible to request adjusting the visa to 90 days once I have my new passport or I need to request is as soon as possible

Yes you could wait till you have the new passport and at the same time have your permission to stay transfered to the new passport, which is also free.
