leomiguel Posted March 25, 2010 Posted March 25, 2010 Can anybody answer me this question.my thai wife and i have been married for two years now,plus she has her spanish NIE number for five years.Can she apply for dual nationalty(ie spanish/thai) without having to give up her thai nationalty.I am a dual national (english/spanish).So she can apply through being married to a spanish national.plus does anyone know if i could apply for her to have dual nationalty (english/thai) by means of my english nationalty,but not being a resident of the united kingdom,as i have lived in spain for the last 35 years.Any advice would be gratefull.
7by7 Posted March 25, 2010 Posted March 25, 2010 Thais are allowed to have dual nationality, so there is no problem at the Thai end. However, she cannot apply for British nationality, even though you have it, until she has satisfied the residency requirement. That is she must be free from any UK immigration control and, as the wife of a British national, have been resident in the UK for at least three years and during the three years prior to applying have spent no more than 270 days out of the UK with no more than 90 days in the final year. She would also have to satisfy the Knowledge of language and life in the UK requirement. So British nationality is out, unless you are prepared to move to the UK. I don't know the rules on Spanish nationality, I'm afraid.
