Overstay

Featured Replies

Hello,

Firstly, my dilemma visa expires three days prior to my departure from BKK...... if i overstay and pay 500B?! per over day (rather than go all the way out to immigration, loooong taxi ride, extend 1900B!?) is there any problem with just paying the fine at the airport ?? Or in the long term, If i should want to return to Thailand, does the 'overstay' affect this?

Secondly, i have been visiting my young neice, who is married to a Thai guy and live here with their young daughter. Since my neice returned to Thailand, after giving birth in the UK, her visa and her daughter's visas have expired almost 10 months ago :realangry:

They say they have been meaning to sort out the baby's Thai nationality, but haven't. She'll sort out her overstay and that it's maximum fine of 5000B or 10000B or all sorts.....

Please can someone shed some light on this for me?? Any advice greatly appreciated!!

Many thanks.

On your overstay, no problem paying at the airport. The overstay stamp in your passport will not affect future entries into Thailand.

Well, at least that's one down!!

Thank you!

No worries! I've done short overstays a couple times over the years and haven't had any problems.

Somebody with more knowledge than me about your second issue should be along shortly to help out on that.

Cheers!

If I'm not mistaken, I believe the 'legendary' blacklist is looked upon casually or non-existent if overstay fines are paid up in full - even if one is two years overstayed and the complimentary B20,000 maximum fine is taken care of. It's all very business like and black marks are never applied to your record.....if you play the game correctly.

Also........depending on the age of the young one, overstay fine will not apply to the child.

If birth of child was in the UK the birth certificate showing the Thai father must be presented to the Royal Thai Embassy to make a Thai birth certificate. With that the child can be registered as Thai in Thailand. It is almost impossible to do from the Thai end from reports here - that document from Embassy is vital. So you may want to talk with them about that.

Any overstay could be used for restrictions but a present it is not and unless you are involved in legal action during that time it should just be a 1,500 baht fine at airport. But it is never completely safe to be overstay. I would make the taxi ride myself as it is a nice location and building and may provide a glimpse of Thailand you have not seen.

Your niece should have obtained a one year extension of stay if in a registered marriage. Very simple for foreign wife to obtain. Is marriage registered in Thailand? If not but was in UK first step is UK Embassy/translation/MFA registration/District Office registration of paperwork. At this point it appears she show must exit country and pay 20,000 baht and return to be legal again.
