ANY overstay is illegal :o

After 30 posts in this thread we still do not know for what alleged infringement of what Thai law or regulation the mysterious British citizen (I shall call him Mr Brit) has been refused entry and detained upon his arrival at Bangkok airport, nor whether his detention continues. The reasons stated so far are that Mr Brit “was refused entry into Japan” and that “the Immigration boss was visiting the airport at the weekend”, for which reason “everything was being done by the book”.

To summarize the reported facts:

1. Babyg intends to accompany a Thai friend of hers, presumably female, (I shall refer to this person as Ms Thai) to Japan, purportedly to visit an exposition in Nagoya that ends on the day following the planned arrival in Japan.

2. Babyg accompanies her Thai friend to the Japanese embassy in Bangkok to assist her friend in obtaining her visa for Japan.

3. Babyg cannot go and instead Mr Brit accompanies Ms Thai to Japan. Mr. Brit carries Japanese money, credit cards and hotel information with him.

4. Upon arrival in Japan, Mr Brit is refused entry, and so is Ms Thai.

5. Upon re-entry into Thailand – without a ticket for an onward flight – Mr Brit is refused entry and detained at Bangkok airport.

6. Mr Brit previously lived in Thailand for over a year.

I believe we can safely disregard Japan’s refusal for entry and the speculative reasons for that refusal, as they are unlikely to have been a contributing factor to the Thai immigration authority’s decision to detain Mr Brit upon arrival at Bangkok airport. Any refusal to enter Thailand would be based on Thai law and regulations.

There must be dozens of possible reasons for which an inbound passenger can be refused entry and it seems pointless to speculate what may have been the reason in this case. An assumption has been made that that Mr Brit was in Thailand on a long-term visa but Babyg has neither confirmed nor denied this, nor does she probably know.

Too much remains unknown, left open to speculation that something serious must have been wrong with Mr Brit or his passport. Or could it simply be that he had no valid visa and was refused entry because he had no ticket for onward travel? But in this case he could have used one of his credit cards (see point 3 above) to buy a ticket immediately.

My conclusion is that we do not know the whole story, and that we shall never know it.
