Waiting Now 44 Months For My New Condp

Featured Replies

About 44 months ago I place a deposit on 2 condos At Grand Siritara Condo, Mae Hia Chiang Mai, near the airport. I was the second purchaser

I have waited quietly and patiently for my units though they have been delayed over and over again.

Today with no warning I received notice that they were terminating my contracts.

I heard they think they can sell them again and make more profit.

A warning to others about Aruniwa the developer and Grand Siritara condo.

As a note, does anyone know a good Lawyer that deals with condo issues in Chiang Mai ??

Wow! Please don't think this is rude because people are going to be wondering, was there anything they mentioned in the letter justifying the termination? For example, breaking some fine print stipulation in the contract, missing a payment by one day, etc.?

More importantly, what does the purchase agreement say about Termination and Suspension? A well-worded Termination Clause, unless there is a third party involved, should only have a Termination By Default Clause and not a Termination By Convenience Clause. The specific circumstances under which the Termination clause can be applied too should be clearly stated.

With regards to the delays, what clauses regulated completion time and consequences for delays, and has the developer ever claimed force majeure during the construction period?

All the above-mentioned matters are paramount if the OP shall have any success in getting compensation.
