Paying Long Overstay

Hi,

This is my first post on Thai Visa,

A quick question, I have a overstay of 13 months, I am sorting a flight out to go back to England that will leave at the end of November, but as the floods are in Bangkok my family have said can i pay my overstay at Koh Samui

airport when i get my connecting flight to KL,

Will i be able to just pay the 20,000 at Samui airport and get my flight or will i be detained at the airport?

Thanks for reading this, I'm getting quite worried as there are lots of stories that differ greatly...

Thanks for getting back to me, Yes you are right i am a idiot and there is no excuse for overstaying this long.

Now thats out of the way, I will be flying from Koh Samui to KL and will not be going to Bangkok, So will there be any problems paying at the Samui airport?

The outcome of your Samui adventure in November now, cannot completely sure be predicted.

But I would bet, they let you board the plane. But not come in the last minute, maybe they want to talk a bit with you.whistling.gif

Thanks for the link smokie, By reading the link you gave me, it seems Phuket and Bangkok will give you less hassle than Samui, That guy who walked through Phuket with 3.5 years overstay had no trouble but the person at Samui Airport was arrested and hauled in front of a judge.

All i want to do is pay and leave, I would fly from Bangkok but have been warned it might flood by the end of November, so this is why i am asking about Samui (i live on Samui). All in all it is going to cost me over £1000 including the overstay and it took a age to save this up, so i don't want to be denied exit as then i would be screwed...

I don't mind flying from Phuket, i can just get a bus there the day before, but Samui is a much easier option for me as i can fly directly to KL and get my connecting flight home...

You could try posting this on the Samui forum. Maybe some of the guys on there have a better idea of the immigration issues at the airport there but as anyone who spends time on Samui knows the shakedown usually happens at every opportunity.....

I'd bus it to Phuket and fly from there if it were me. A wasted day I know but far more piece of mind no matter what anyone says on here.

Most likely the gentleman that spent two days in jail at Koh Samui was detained for something by the police, possibley over roudy after a night at the Green Mango. When they asked for his passport they noticed the overstay. No flights out at 2am so in jail he went. Once in the clink you have to go before a judge to get out. Most likely he had to pay a "fine" to the police and was escorted back to his room to pack and then to the airport where he had to shell out an additional 20000 to immigratioin with his escort standing to one side waiting to be paid for his escort services. Remember the police don't get any pat of the 20000. To put your mind at ease take the bus to Phuket, but don't give the police any reason to stop you.

I used to own a bar on Soi Green Mango and that's how it worked then. Just don't get stopped by the police for any reason before you get to immigration. If you do, it doesn't matter where you are, you're likely to face the same senario.

I think you and Smokie are right, just get a bus to Phuket and fly out from there. I have posted this topic in the Samui forum as well to see if anyone has ever got through Samui without hassle.

For peace of mind i will more than likely bus to Phuket (under the radar) and leave that way...

OK, I apologise for my earlier rant at you as the comment was definitely over the top, Ive just got this thing about farangs that run up such long overstays because apart from a few exceptional circumstances there really is no excuse for it., to your credit, you have acknowledged that and i would hope that you wont let it happen again.

why can't you just goto immigration in samui and pay it the day before your flight ?

He needs to pay just before departure as he will still have no valid permission to stay in his passport as it has expired and will still be illegal for another day.

General question about overstay: If caught with overstay (not at the Airport), I take it the first stop will be the jail. Then a rendez-vous with a judge I suppose. How long would one have to stay in jail until he gets to see the judge and/or being deportet ? Days, weeks or months ?

AND: What happens to a fellow that can't pay the 20'000 Bht fine ??

I am not going to risk going to the immigration office in Nathon Samui as it will be like putting my head in a noose,

I'm going to have to pay at the airport which is disscused before and it seems Phuket is the better option rather than Samui.

In a ideal world Bangkok would not be flooded and i would head straight for there, but I am left with the options of Samui, Phuket airport or the land crossing at Sadao..

Does anyone know if it will be trouble at Sadao immigration (without the minibus driving off and leaving me, it's happend before) or is it best to fly?

Either way i don't mind i just want to pay this and go home to see my family....

If you get caught before arriving at the border point or airport you will not pay the 20.000baht fine ,it will be up to the judge how much you get fined normally no more than 5.000baht with around 200 baht a day taken off for your detention........but you will have to stump up for the cost of a flight to your home country.

The length of time you are in jail depends on when you can be put up before a judge normally within 3/4 days and then you would get transferred to the IDC until somebody arranges your flight home,then you will be escorted to the airport by the police and waved bye bye before they say see you soon!

Access to the airport in Bangkok is ok at the moment,if you have around 50.000 baht saved then don't worry you will be ok,you have enough to get you out of jail and on a flight home,i would go to Bangkok airport now while the chaos rules,just tell a close friend who can help you out with sorting tickets out in the worst scenario ......good luck! wink.gif

I think that your best bet is the bus to phuket. Since Samui only has 2 international flights per day they probably don't have the ability to collect the overstay at the airport, hence the trip to Nathon and you missed the airplane and are in the country illegally so where do you stay. Cross Bar Hotel? I guess that I can see how that guy ended up in jail even if he did not have a run in with the police.

If you go to Sadao, as you said, the van might not wait for you while you muck around sorting out the overstay so your stuck at the border crossing.

The reason I said what I had. was because for the first time ever I had indeed overstayed by just one day earlier this year in September.

I honestly didn't think I was going to make my flight for a few minutes. Obviously without even a fine to pay I was surprised. My immigration record is spotless and the only thing I can add is that I was using a brand new passport.

My thoughts had come from my experience over 1 day to the OP's overstay of a year plus. I would suggest that he trys to pay in advance but no doubt that leaves him under risk of being detained ??

I have never overstayed so I am not speaking from experience.

From all of the postings that I have read people that have overstayed went to Bangkok Airport to catch their flight out of Thailand and were made to pay the overstay fine, maximum 20000 baht, and were allowed to get on their airplane with out any stamp that did not allow them to return to Thailand at any time. They did not have to board a flight to their home country. The only exception that I read was from the guy at Koh Samui that spent two days in jail - no explanation why. Samui only has one or two international flights a day and may not have the facilties to collect overstay fines at the airport. There are three flights to KL per week; Monday, Wednesday, Friday. If he goes on Monday and they make him go to Immigration in Nathon to pay the overstay fine then he has missed his flight on Monday and the next flight is Wednesday. He has now reported his overstay to immigration but he can not leave for another two days. Where is he going to stay Monday and Tuesday night? Maybe the cross bar hotel. I'd take ths bus or fly to phuket and arrange an international flight from there.

5 months ago it was announced that people who were more than 45 days overstay can and will be jailed and it was on a forum on this site. If you are stopped by the police and you are overstay you will be arrested jailed and deported. It usually take about 5 days to get before the courts. If you cannot pay the overstay you stay in jail until the embassy help you.

If your apprehended for any reason , you will belocked up for the overstay, happens all the time.

I hear flights to England are cheaper from Cambodia so why not exit by foot to Cambodia, pay the fine and leave from there that way if theres a problem you won't have wasted money on flight you can't use. Just a thought I have no actual experience with this.
