Nothing new in this news. Child abuse by Ozzies and yanks is quite prevalent in Thailand and much of SE Asia. Last month I was in Chang mai near mae sot. I saw this very unsavory american with a little boy. I am guilty I did not at least enquire what this 60 old fat individual was doing with a 6-8 year old bot that apparently spoke no english.

You sound like an expert. What country would you say visiting Thailand it is not prevalent?

Nisa. You have some good points, but may I remind you this is Thailand; not the USA or Australia. You follow the rules here like the noble little person you are, and turn yourself in and you'll find you've made the biggest mistake of your career as a free person. Why do you think the Thais flee the scene? What honor and justice is there in turning yourself in when you are walking into a pit of vipers, especially when you are 93 years old, on a pension, all alone in the world and most adamant about your innocence (he did say he is innocent, Nisa, so give him the same credit that you give to known liars)? When in Rome, do as the Romans. Nisa, there is a reason the Thais flee the scene. It is because they understand fully the consequences of turning one's own self in to Thai justice!

When you talk about flee the scene, I assume you mean the stories we hear about of hit and run drivers as I am not sure it is standard practice anywhere for child molesters, bank robbers or other criminals to wait around for the police or turn themselves in. So, lets first assume that hit and run accident are not also common in other places, especially by drunks, uninsured and/or unlicensed. Lets also assume that there isn't a great number of folks who flee in Thailand after an accident only to turn themselves in later. Once we do that we can then look to see why Thailand possibly has this problem more and we can come to the simple conclusion that there is no real penalty for fleeing the scene of an accident in Thailand and if you have been drinking it is in your best interest to flee and then turn yourself in later to avoid the penalties of being drunk and causing an accident.

My point is that relating hit and run accidents is well off the mark and absolutely no connection.

This guy was arrested and he was allowed out pending trial and he chose to flee. He didn't turn himself in the first time but instead the big bad lying police took him from his home and he was still allowed out on bail. He then chose to flee the country. In other words, there is clear evidence he broke the law and he is not one to keep his word and he cannot be trusted and nothing at all to indicate the police or justice system treated him unfairly. In how many other country's would a foreigner, regardless of age, accused by three girls of child molestation and finding child porn in his home be allowed out on bail? What country after granting bail in such a crime, due to the old guys age and health, would give him a second chance of bail once he fled the country?

You can talk all you want about problems with the Thai police or its justice system as you can just about any country but it doesn't mean people don't commit crimes and that bad people shouldn't be tried and sentenced. If there has been anything reported to indicate the police, prosecutors, courts, 3 child victims, children's parents, neighbors and the maid have conspired against a 90+ year old man then I have missed it. The stories I have read seem to indicate that authorities have been more than fair to him and he has proven he is not somebody who can be trusted.

Personally if I thought the justice system was so corrupt in a country and it was common place for such things as mass conspiracies by citizens, the government and my embassy in this country then I would have to say it would be the last place I would ever choose to live let alone visit.

Fair enough. You trust 'em. I don't. You have no idea of the inner workings, from the lowest copper to the top judge and the prosecutor. I do. That makes reading your words meaningless to me. I truly hope you never find yourself in their grip. You'll be rotting in jail or have your passport confiscated until you realize that money erases all sins in Thailand, and shouting, "Justice", brings nothing but regret, shame and poverty.

Absolutely absurd to feebly attempt to implicate one or even two nationalities as being the prevalent offenders. A simple review of past threads reveals offenders from every Western country with no discernible proportional prevalence amongst any of them whatsoever.

Actually, it isn't a prerequisite... Although all Popes in the modern era have first been Cardinals, Canon law would permit the voting Cardinals to elect a layman if they so desired.

Pope Urban VI, elected 1378, was the last pope who was not already a cardinal at his election. Canon law requires that if a layman or non-bishop is elected, he receives episcopal consecration from the Dean of the College of Cardinals before assuming the Pontificate. In Australia it is digital penetration to constitute rape and does not have to be the penis. Any digit or object ( bottle, dildo broomhandle) will suffice.

To be clear we don't have any idea of the evidence submitted to the court to date. We only have what is in the papers and as we have all found out that is usually neither fully accurate and never complete. For the sake of argument and debate I tend to go with the gist of what is reported but on the other hand we have no idea how accurate anything reported is but some things like his fleeing to Burma seem to be something that surely he did do given we have pictures and reporters at the scene. As for the other stuff (pics, email, maid, parents, neighbors and kids), I tend to believe the gist of the accusations but certainly wouldn't be surprised if some of it turned out to be BS.

Keep in mind the police gather evidence for the prosecutors and they have to submit it to the judge in order to keep the defendant detained and they need to do this periodically for I believe about 3-months at which time the investigation portion ends. The judge needs to be convinced enough of the person's guilt to continue to hold him during this period. Though I am not sure how his fleeing the country plays into this and it may automatically disallow bail even if the evidence is very weak. It is a guessing game as to why he was allowed bail to begin with. Could have been his age and condition and/or the case was weak. Bottom line you usually don't see bail for a foreigner in such a case just about anywhere but then again you usually don't see a 90+ year old man accused of such crimes either.

As for motive ... you don't need to prove one and I think it is pretty obvious. The only mental state issue that might apply here is if he knew right from wrong (insane) but not even sure about Thai law and this point.

Bottom line is when there is smoke there is usually fire and I just don't buy that there has been a mass conspiracy to frame this guy for a few bucks and don't believe the pictures are a lie as the police, prosecutors and judge would have all seen them by now and if they don't exists then regardless of his guilt, they are defaming him and there would be serious repercussions and something that I do believe his government would step in regarding as this would go way beyond mistaken criminal charges but a government actually unlawfully (if they lied about the pics then nothing can be believed) detaining a 90+ year old man for one of the worst of possible crimes while defaming him across the globe. At the very least they would issue travel warnings even if they couldn't get involved in the proceedings ... I also have a feeling the embassy has seen the pics on the side to eliminate any concern in their mind of the abuse of this man.

I don't see why not either, as all of the clergy of any faith or the brothers and nuns who have been found out being sexually naughty with children, have normally only been moved to another location, out of sight out of mind. The extreme cases, have got the sack and rarely imprisoned.

The old German has been charged for +/- 2.5 years by Thai justice. This seems me long enough to come to a verdict or not ?

Depending again on the relevant evidences. Regular, similar cases take between an acceptable 6 months and 1 year.

Who would not try to escape out of a country after 2.5 years of 'false' accusations ?

But we know that a new judge has been appointed to the case and police investigation should be completed after all.

I understand completely that his lawyer is claiming legally that he's no more fit for trial.

If they don't have the hard evidences now for a verdict on his charges, they will not have them in the future.

Resulting in a non-verdict means that the same man has been charged twice in the past in Thailand for the same type of crimes with minors in 2 different cases, and twice released for lack of evidences...

His long detention is not in line with his guilt. Even so, which reasonable embassy would offer 'muffins and juice' to a real pedophile ?

As I've said before, I have no idea of whether this guy is guilt or not...

But, I think your post above gives too much credit to the Thai judicial system, presuming that it will operate in an objective way wherein the judge/judges will impartially evaluate the evidence against a farang criminal defendant prior to trial and dismiss the case if the evidence isn't credible/substantive.

That may be the case in other countries, such as through the preliminary hearing process. But I've seen no evidence or indication that that kind of process exists in reality here, particularly regarding a farang criminal defendant. Rather, the norm seems to be that a defendant will sit in jail until they can obtain a not guilty verdict at trial, which rarely seems to happen here.

And needless to say, the Thai police have hardly proven themselves to be professional, impartial, reliable investigators of alleged crimes.

Instead, the norm here seems to be that rich and influential people literally can get away with murder, but those without influence or resources can get put away for years under dubious circumstances. You certainly don't want to be in the latter group in Thailand's criminal justice system.

No problem, keep him in the hospital jail ward and see if they can help him get fit for trial. Hopefully they can help get his mind and body back to the point it was not long ago when he was able to sneak out of Thailand and into Burma.
