Hi,

I looked and I believe for a Canadian national the salary needs to be at least 50 000 baht per month. The only thing I'm wondering as I couldn't find is if this salary can come as a dividend. Also what if the salary/dividend comes from a holding company in Hong Kong or Singapore that owns the Thai company?

Thanks

It is for one-year extensions of stay for the reason of employment that Thai immigration specifies a minimum monthly salary but there have been reports that in some provinces the Department of Employment uses the same salary requirement for some types of work permit. Obviously, for a work permit for employment in Thailand your salary must be paid by a Thai employer.

Sorry I wasn't clear enough. I mean when it's your business and you want a work permit from it. Will paying yourself in dividend count as a salary.

The salary required for a work permit (other than teaching) varies with your nationality and is payable on that amount regardless of how much you actually earn IF, but only if you wish to renew the WP and visa the following year. To renew you have to produce the tax receipt stating that the correct amount has been paid if, you do not wish to renew you can pay tax on what you actually earned but, you will be refused a renewal - thank you and good morning!

Not sure dividend will be considered salary, might be considered income from investment or which no WP is required. But you would need another reason to stay in Thailand than work.

Their is no minimum salary requirement to get a work permit according to the regulations.

Their is a minimum salary requirement to get an extension of stay to work at immigration.

For a new start up company you will not be able to get an extension of stay for at least a year meaning you will have to use a multiple entry B visa and make border runs for that first year.

What you need is personal corporation income Tax (PND.1) in latest 3 months and personal income tax for previous year (PND.91) with receipt.

This must show your income at 50.000 baht.

Where a government requirement specifies salary you cannot substitute dividends for salary. The fact that you "own" the company makes no difference.
