Pheu Thai MPs resolve to deny Constitutional Court's power

BANGKOK: -- MPs from the ruling Pheu Thai Party resolved yesterday to deny the authority of the Constitutional Court in hearing a new case against parliamentarians supporting constitutional amendment, party spokesman Prompong Nopparit said.

They also agreed to send a 12-page open letter to all independent agencies, except the court, later this week to explain why they believe that the court has no power to hear the new case, according to the spokesman. The MPs are convinced that the legislators are entitled by the Constitution to make changes to the charter.

A group of lawmakers recently proposed amendment to Article 68 that would prevent public members from petitioning directly with the Constitutional Court. A group of complainants later filed a petition with the court, accusing the lawmakers of attempting to overthrow the country's democratic regime through constitutional changes. The court accepted the petition for trial, which led to strong opposition by Pheu Thai MPs and their red-shirt supporters and their legal confrontation with the court.

The Pheu Thai spokesman said that if the Constitutional Court continues with the case, the party's MPs would begin their move to impeach the court's judges. He said that more than 100 MPs have signed a petition for impeachment.

He said that in denying the court's authority, none of the Pheu Thai MPs - including House Speaker Somsak Kiartsuranond - would present their explanation to the court, in response to the petition against them.

For a group who profess support for demoracy for Thailand, they need to do a lot of research l about the function and duties of the Judical branch. With the self proclaimed " law schooled" public servents trying to rewite laws, constitutions, etc via threats, mob protests, intimidation, pay offs, etc, they should disbar the lot. Then jail them for impersonating an educated part of the system.

Poor Somsak (not). He clearly has no say. Another pawn in TS's game. Have to be fair, Somsak most probably is a very rich man by now.

So Thailand is destined to be ruled by coupist's! Whether it is a bunch of dictatorial MP's belonging to a dictatorial political party or the military, a coup is a coup and this is nothing different. Same, same!

IF the police join the party and refuse to accept the courts decision, then whoever instigates this is guilty of treason. This is a direct attack on the Constitutional Monarchy.

I think this is a good idea it will save everyone at ThaiVisa, trying to point out to PTP, in short, failing miserably to interprete the word democracy ,Thailand Law , the courts, the judges are now under attack , they take the same course as the Thaksin government, history is repeating it's self.bah.gif

most of these idiots in the govt cannot even read let alone know what the law is. All they are doing is exactly what their paymaster is telling them too, yingluck is is the same boat as well. A coup sounds pretty good with this crap happening, maybe then the courts can actually do their job without all the gardbage these idiots are causing. Cant wait to see the ptp dissloved and all of them tossed in jail along with their red shirt cousins, that would be priceless, we might even see thaksin finally be returned here to face justice, oh joy.

The right of the law??? It's the constitution, and they're the constitution court. They do have the right to review issues related to the constitution.

Since they have not ruled and only excepted the guys petition they haven't restricted anyones rights. It seems many are getting the cart before the horse

I don't see what they have to worry about if what they are trying to do by amending the constitution is legal.

If it is then surely it is in their favor for the judges to hear the petition.

For then the judges will find in their favor and then they can say for certain it is legal and correct as it has been scrutinized by the court.

But then again if what they are trying to do is against the law.................................................................

My thoughts exactly - clearly worried that the court won't rule in their favour - wonder if they'll send the red shirts to the Hague if the ICJ verdict goes against them??

Agreed. But Thaksin SHOULD have been charged with treason YEARS AGO.

But TiT... no one will ever be charged with treason, until AFTER the dust has settled. And even then, maybe not.

Isn't the court legally obliged to hear a case if they are petitioned to do so?? If a court is legally petitioned according to the legal and technical framework in a the country to hear a case but rejects it, before deliberating the merits of the petition, is that outright rejection legal?

The petition simple is asking the court to rule on the legality of the possible legislation - and if PTP are so confident that the legislation is legal, then they should be encouraging this.

Wasn't that always going to be the case,once the man from Dubai ran out of patience?and to get the Constitution changed in his favour,and so allowing him back,without a single day spent in the Monkey House!

That's Democracy PTP and Red Shirt style,soon enough none of this will matter,it will be a lawless Country,presided over by the Lawless!
