hi guys

this may be a stupid thing to ask but here goes any way. i have been living and working in thailand for around two years now and i wish to apply for a a settlement Visa for my Wife to go to england. so that if some time in the future we wish to move to england we can. she has been on holiday to england before with me for a month no problems there we also are having a baby due in july. the problem is that i have no ties with back home no house no job ect because i live and work here. but we would to have the option to move to england if we whanted to. so can i get a settlement visa while living and working in thailand ?. i have enough money in the bank to make the move when i whant set up home in england but i would not like to go over on my own seting things up geting a job ect. and not seeing my wife and baby for months while the application goes thro.

If you are not planning to settle in the UK just yet, then there is no point in applying for a settlement visa now. This is especially true if you wish to continue living and working in Thailand. She would also not qualify for a spouse settlement visa because you do not intend to settle. She should apply for a settlement visa only when you are ready to settle in the UK. See 13.5 - Spouses and how they qualify.

There is also another advantage if she waits. If she applies for a spouse settlement visa after a period of 4 years outside the UK then she would get the ILE (indefinite leave to enter) immediately and will not have to wait for the two years probationary period. See para 281 ( b ) and 282 of the SPOUSES AND CIVIL PARTNERS immigration rules.

Your wife may be able get a long-term multiple entry (up to 10 years) UK visitor's visa for the time being. This should not be difficult as she has been on holiday there before.
