Home Court Divorce Decree necessary?

Featured Replies

Hi all

preparing to get married some time next year, I read many times that the Thai Amphoe will (might) ask for a translated and legalized copy of the divorce decree from my home country.

I am unclear whether this is really necessary? When I go to my Embassy to apply for the "affirmation of freedom to marry", I must show a recent civil status document, which is an official paper from the Swiss civil status registry. This clearly shows that I am divorced and based on that document, I will get the marriage affirmation from my Embassy.

Therefore my question to people who were divorced in their home country previous to get married in the Amphoe: Did you have to translate, legalize and show the divorce decree from back home? I am asking, since the divorce decree as issued here in Switzerland is many pages (7 in my case) with all the details about the divorce agreements (i.e. payments, split of assets, child custody etc.) which I doubt are necessary to be shown / given to the Amphoe.

Thank you for telling me how it worked for you (not what the law outlines).

All i did was take affirmation document from my embassy to Amphur along with all other doc's specified and that was it.

Per above, at least some amphurs will only want to see the embassy confirmation letter.

Remember, you can get married at any amphur in Thailand. Choose one in a place with a lot of foreigners and normally there is no problem. if you do run into problem, simply go to another amphur. You can always check with the amphur beforehand if the embassy letter will be enough.
