Very misleading headline, they've been accepted for a hearing, with regards to them going on trial, they're not on trial wink.png ....yet!!

Suthep issued orders to the Army to end the protest by all means necessary including deadly force, his orders endangered lives.

The army were tasked with controlling a mob armed with weapons such as AK47s, rifles, rocket launchers and grenades. You can't give the army this task without allowing them to use deadly force. You either allow deadly force or you don't ask soldiers to bring things under control, and let the mob do as they please.
