CMPO to let Emergency Executive Decree expire and reinstate Internal Security Act

BANGKOK, 14 March 2014 (NNT) – The Center for Maintaining Peace and Order (CMPO) resolved on Thursday to let the Emergency Executive Decree in use over Greater Bangkok expire, and to revert to using the Internal Security Act to facilitate peace and order instead.

At a meeting to deliberate over the expiration of the Emergency Executive Decree on March 22, most CMPO officials saw fit to lift the emergency decree and tone down the use of special law by reinstating the Internal Security Act. However, the officials indicated they would continue to press charges against those who obstructed elections and those who trespassed state offices.

CMPO committee member Tharit Phengdit spoke to reporters on Thursday about the premeditated murder charges against Prime Minister Yingluck Shinawatra and 5 other individuals, which was brought to court by families of those killed at the Phan Fa intersection during clashes between anti-government protesters and security officials on February 18.

According to Mr. Tharit, the CMPO's operation at the Phan Fa intersection was not a protest dispersal, but was an operation meant for arresting persons who had committed offenses, in accordance with the court's arrest warrants. The operation was also geared toward freeing up state offices and roads, for the benefit of the public.

Mr. Tharit added that the operation was carried out openly under the observation of members of the press. During the operation, security officials were also able to seize a number of weapons, narcotics and other contraband.

Nice to hear k. Tarit again and helping Abhisit/Suthep as well. I mean if he doesn't believe in the 'premeditated murder' charges against Yingluck c.s. because a.o. weapons were found, the same applies to the April 10th 2010 activities. Grenades were found (to kill army personel).

Anyway, with the situation in Bangkok still serious we'll let the Em.Decree 'expire, as in leave it till the 22nd.

Now can some one tell me what the proposed application of the I.S.A. from that date really means ?

You'll find the specifics online, but essentially it will actually allow them more "control" and "options" than the current SoE as the current SoE has been muzzled by the Courts. So when the ISA comes into effect again, everything is reset and the games start all over again.

CMPO May Revoke Emergency Decree By 18 March

BANGKOK: -- The Centre for Maintaining Peace and Order is aiming to end the State of Emergency over Bangkok by 18 March, a top official said.

The government of Prime Minister Yingluck Shinawatra declared the emergency decree over Bangkok and its neighbouring provinces in January in an attempt to contain the anti-government protests led by the People's Committee for Absolute Democracy With the King As Head of State (PCAD).

But the CMPO has recently concluded that the situation can be maintained by repealing the State of Emergency and resorting to the Internal Security Act, which was imposed over Bangkok prior to the SoE's enactment in January, said Lt.Gen. Paradorn Pattanatabutr, secretary-general of the National Security Council and a secretary to the CMPO.

The CMPO will seek approval from the Cabinet on 18 March. If granted, the State of Emergency will be revoked on the same day, Lt.Gen. Paradorn said.

He expected that the government will retain the power of the Internal Security Act until the end of April in order to provide public security for the Senate election in that month.

The State of Emergency granted the authorities a sweeping power to contain the protests, such as banning or suppressing any political gathering, banning the use of certain buildings and roads, detaining suspects without charges, and censoring the media.

However, a recent ruling by the Civil Court strips the CMPO of many of those powers, rendering the emergency decree powerless in the eyes of many observers.

This is the reason why DSI has not replied to my questions 1: what has happened to the luxury imported car scam and 2: the disappearance of the human rights lawyer, I have noted DSI, that no charges have been laid in case 1 and you really haven't made any progress on number 2, lets face it DSI , you have been brown nosing that much and so far up the PTP arse that you are probably finding hard to breath at present , the risks some people take..bah.gif

This is laughable Tharit! You must think that Thai people are all stupid and that they have forgotten that Chalerm promised us multiple times that he would clear the demonstration sites (here is one example http://www.thaivisa.com/forum/topic/705313-chalerm-vows-to-take-all-demonstration-sites/) and now you dare to say that it was merely done to arrest some person. Unbelievable.....

...unfortunately....possibly.....look at what they have gotten away with to date.....and they are not letting up one bit.....

Cabinet to consider lifting emergency decree next week

BANGKOK, March 14 - National Security Council (NSC) chief Lt Gen Paradorn Pattanathabut said today that the Center for Maintaining Peace and Order (CMPO) will ask the cabinet next week to lift a two-month state of emergency imposed in the Thai capital and its adjacent provinces to handle the anti-government protesters.

NSC secretary-general Gen Paradorn, said the meeting of security agencies agreed to raise the idea with the cabinet next Tuesday as the emergency decree is due to expire March 22.

He said the Internal Security Act (ISA) will replace the emergency decree in the same areas and officials are discussing whether it should be enforced until end of April or early May.

Gen Paradorn as CMPO secretary-general, said security agencies estimate that the People's Democratic Reform Committee (PDRC) will be active again during that period, while the elections will also be held.

Gen Paradorn noted that if the situation turns violent, the security agencies can ask the cabinet to reinstate a state of emergency.

The NSC chief added that only the law enforcement is changed but the CMPO will continue its duty under the same name and its headquarters will still be at the Police Club.

Following the ruling of the Supreme Administrative Court that the transfer of former NSC chief Thawil Pliensri by caretaker premier Yingluck Shinawatra was unlawful, ordering that she must reinstate him within 45 days, Gen Paradorn said he is ready to follow the instructions of his superiors.

Gen Paradorn said the PM's Secretary-General Suranand Vejjajiva has informed him that his position will be returned Mr Thawil as stated by the court and that he will be appointed as the premier's advisor. The issue is expected to be discussed in the March 18 cabinet meeting.

After the cabinet decides on the NSC chief position, they will forward the resolution to the Election Commission for consideration, as they are only a caretaker government. The names will be later sent to His Majesty the King for his endorsement. The whole process, Gen Paradorn believes, will not take more than 45 days. (MCOT online news)

“Internal security operation” means, for the sake of public order or national security, the measures to preserve, control, solve and restore the state of normalcy from any situation which is the result of an act of a person or group of persons exposing or likely to expose life and limb or property of the citizens or the State to injury;"

It clearly puts the prime minister in an unenviable position. She becomes responsible for everything that is done in the name of any internal security operation (ISO). There may, however be a get out of jail card for her since she is not the real prime minister but only a caretaker one.

If she is removed from office then I suspect any ISO's then become illegal.
