Hi everyone,

Could you please give us an idea about the kind of questions that the immigration judge and may be the home office presenter ask during an oral hearing spouse appeal?And please how long it usually takes....We just worry

The officials are trying to ascertain the legitimacy and nature of your relationship, and the probability that the woman will return to Thailand. That's it, pure and simple. Be open and honest, and treat the official with respect. (S)he has nothing to lose by denying your application, so it pays to be attentive and polite. Desperation is obvious, and it doesn't your cause.

It's difficult to foresee what questions, if any, the immigration judge will have: what is asked will depend upon the circumstances of the case. Generally speaking, however, the judge will only seek clarification of a given point from you. The Home Office Presenting Officer, however, can cross-examine you on any oral evidence you give, so his/her questions will revolve around what you say. If you are unrepresented, the judge should assist you by guiding you through the process.

The length of the hearing will depend upon how much evidence there is. I've attend some where it's lasted 20 minutes and others where it's gone on for a good 3-4 hours. Furthermore, it is unlikely that you'll get a decision on the day. The judge will normally reserve judgement and you will receive a written record of the decision within 10-14 days.

PS. Have you submitted your bundle to both the court and the Home Office? This should be done at least 5 days before the appeal hearing.
