Constitutional Court decides to proceed with case against PM

BANGKOK: -- The Constitutional Court decided Wednesday to proceed with a petition against caretaker Prime Minister Yingluck Shinawatra who has been accused of breaching the charter with regard to the transfer of the National Security Council chief.

Constitutional Court judges voted unanimously to proceed with the petition.

The court demanded that Yingluck defend herself within 15 days.

Appointed Senator Paibul Nititawan and 28 other senators filed the petition, which alleged that Yingluck had breached the charter by ordering the transfer of NSC Secretary General Thawil Pliensri to an inactive advisory post at the PM's Office.

The Supreme Administrative Court ruled that Yingluck's order to remove Thawil as the NSC chief was unlawful.

The group of senators filed the petition following the Supreme Administrative Court's ruling. The petition noted that the charter did not allow the government to transfer permanent officials for the sake of vested interests.

Constitutional Court & NACC both decide to proceed with a case against Yingluck Shinawatra for breathing. A group of appointed senators filed the petition stating. 'How dare she steal the people's air? I'm sure she is sending it all to her criminal, fugitive, evil brother in Dubai. Oh and can you please make sure you push this case through before those pesky elected senators get here? Damn elections!"

15 years should be her jail sentence.

Ah, she was wrong to transfer Thawil - who as NSC Sectretary General was well involved in the blood-letting of 2010 (and was unpopular because of that), and moved him (on full salary) to a position out of the media spotlight.

Oh well.

I notice that the gang of 40 didn't even get 40 signatures? Only 29? What happened? Is "the gang" a bit worried now?

Yinluck's time in office is getting very close to being over....just too many charges being brought against her by various people and agencies.

BANGKOK: -- The Constitutional Court has accepted for consideration a petition filed by a group of senators seeking to disqualify caretaker Prime Minister Yingluck Shinawatra over the removal of Mr Thawil Pliensri as the chief of National Security Council over a year ago.

Meanwhile, the court rejected a petition filed by Centre for the Administration of Peace and Order director Chalerm Yubamrung seeking an end to the anti-government protests by the People’s Democratic Reform Committee claiming that the protests are illegal and not peaceful.

A group of 27 senators led by Paibul Nititawan claimed that the prime minister had violated articles 91 and 182 (7) of the Constitution by transferring Mr Thawil from the NSC to become an advisor at the Prime Minister’s Office to pave the way for Pol Gen Priewphan Damapong, brother of Khunying Pojaman na Pombejra, to be appointed as the new police chief replacing Pol Gen Wichien Potephosri.

If the court faults the prime minister of breaching the charter, she will have to lose the premiership and this means her entire cabinet will be dissolved automatically.

Who will make the decision to install a "peoples council" once Yingluck is impeached? Does she not elect a caretaker PM to replace her? The Constitutional courts or the Senate?

With all these cases against her, why don't they just stop messing around, and order her removed from power, and stop this impasse once and for all, and batten down the hatches for the possibility of Red shirt violence, and some here will more be inclined to think that's an inevitability, and they maybe right, but there's nothing positive about any future without a big brass balls decision to move forwards. You have to break a few eggs to make an omelette.

I find it hard to feel sorry for her. I know she has been used by BB. But her moral character was displayed when she lied to the SEC and committed perjury by testifying she did not hold 20 million Baht in shares on Thaksin's behalf. This alone should have disqualified her from becoming PM. Throughout her administration she has displayed the same contempt for the rule of law and the constitution.

Wouldn't it be easier if the parliament building could be located next to the court buildings that way all the participants would not have so far to walk all they would have to do is pop next door. Is there anyone that isn't facing some charge or other?

The Administrative Court's decision affirmed that Tawil's transfer was unlawful. Therefore, the petition was subsequently filed to the Constitutional Court. The fact that the petition was accepted unanimously by the court for review is indicative of the persuasive nature of the case from a constitutional point of view. Keep in mind that Tawil was transferred in 2011, shortly after Yingluck assumed office, because Thaksin wanted his friend Paradorn instead. By so doing, it breached constitutional protocol. It has taken two and a half years through the justice system to get to this stage, so it is certainly not recent. And because Tawil's case was affirmed to be an unlawful transfer, that is why this has come to this stage.

This is all about nepotism and the Shinawatra family.

The family wanted to make Thaksin's brother in law, Priewpan Damapong, head of police.

So they needed to move the head at the time to a nice position - Wichean Potephosree

And to make room for him, Thawil was oiked.

So, as you can see, the nasty and underhand methods of corruption and nepotism were at work

And she should face the music accordingly.

I just hope you are as adamant about the next group...because this isn't about anything but a power grab...alll kinds of things will be coming to bear in the not too distant future which may very well change a lot more than the puppets...you are delusional if you think corruption will ease... it may just be more cleverly veiled...for awhile... but with the information age here and gaining... all the back room deals are gonna be harder and harder to hide...from all factions...

Please can you explain to me the difference between a judicial coup and being held to account and scrutinized for (at least at this point in time) allegedly illegal actions?

In democratic countries every politician, in particular in a prominent position would step back if they had so many legal charges against them.

Good luck for Thailand that the legal system seems to be one of the few systems which is working properly and at least less corrupt.

The foul eggs having no real arguments babbling about a "iudical coup" now are just pathetic
