Khunying Jaruwan needs more time to prepare documents

BANGKOK, 20 April 2014 (NNT) – Bangkok senator-elect Khunying Jaruwan Mainthaka needs more time to prepare documents in order to defend herself against a complaint made by the June 24 Democracy Group.

According to Bangkok EC chairman Veera Yeephraee, Khunying Jaruwan asked for more time to respond to the complaint made against her regarding the senatorial election.

The June 24 Democracy Group has submitted a complaint, which claimed that Khunying Jaruwan had gained the majority of her votes as a result of a speech made by appointed Senator Paiboon Nititawan, who delivered it on the People's Democratic Reform Committee protest stage. The group has alleged that the speech put other candidates at a disadvantage.

Former auditor-general Khunying Jaruwan won a senate seat in the election in Bangkok on March 30th, garnering more than 500,000 votes.

However, if the investigation was not completed by April 29th, the Election Commission would have to endorse the election results, which would make Khunying Jaruwan a legitimately elected SenatorMr, said Veera.

Procrastination is certainly the name of the game in this country ... Do they think that everything will just go away if they put their heads in the sand?

Yep the Thais do the sand-thing, I once heard of 'Bench Warrant" being issued here. Can't remember the circumstances or when it was. If the legal system has such a thing why not give a date to appear and if they don't appear simply issue a bench warrant for their arrest? I am dreaming of course but it sounds good.

That really says it all! tough when you can't find some one of equal stature to boost votes for you're candidate. But is that a reason for this complaint anywhere else they would be laughed at as bad losers!

If the legal system has such a thing why not give a date to appear and if they don't appear simply issue a bench warrant for their arrest? I am dreaming of course but it sounds good.

Why issue an arrest?

This is not a criminal offense she has been accused of. She has been victimized because someone out of her control said something on a rally stage.

If Jattuporn and Nattawut can actually stand on a stage and incite an uprising and assembly of a 200,000 strong and militia trained army out of their very own mouths, and allowed to continue to do so by the criminal courts, as they deem it to be perfectly acceptable behaviour will on bail for the exact same offenses from 2010 terror activities.

Then I can't really see how she can be arrested..

Yet the reds continue to bellow 'double standards'.

The person who urged people to vote for her isn't even connected to her. It was just a foolish statement issued by someone.

What about Kwanchai's wife???.... you saying the red shirts wouldn't have been openly urging the people to vote for her??

You want an individual in court and they don't show, issue a warrant for their arrest. Easy. No excuses!

I think Goat Roper was generalising and he's quite correct about how the legal system operates or perhaps more accurately doesn't.

Courts seem to allow adjournments for the most flimsy of reasons and when the BIB, DSI etc apply for warrants they do so days after they have made their intentions public, well at least in the case of selected wanted persons that is.

Perhaps in this case the delay is justified. The crux of the charge/complaint is that a senator endorsed her in a public speech (presumably doing so in private is okay?) and that this one endorsement/speech was instrumental in her being elected. Given the wierd laws here, it seems reasonable that Jaruwan needs additional time to put a case together to PROVE that this one event (not something she or anyone on her staff/campaign did) wasn't the crucial factor in the election. So presumably she has to figure out some way to explain the election results and show that this wasn't important. Seems difficult to me, a bit like proving a negative.

If she ends up being disqualified, the next election should be interesting. Some senator that is aligned philosophically one way should just endorse every candidate (or at least the ones that might win) that is at odds with his/her philosophy. Careful to not endorse anyone that you want elected. Then get someone to file complaints against all those people. As long as everyone doesn't do this, it should give a consistent group of elected senators. Then time for election law reform.

Do we have any info on what the contents of the speech was ?

BTW how many did actually vote in the senate elections here in the Bangkok 'province' ?

Yes - I think they really do believe that if you ignore things, a large portion will go away or sort themselves out in the fullness of time.

My wife constantly tells me not to worry "about things that might not happen and not too react too quickly to those that do". I've never seen anyone act with a sense of urgency or worry about differentiate the urgent from the rest. As my wife says, more likely farang will have the heart attack, blood pressure or Alzheimer's!

They may just be right!

If I understand correctly there have also been complaints against something like 30 others who won their respective elections, including the winner from where I stay.

Incidentally the interest around here is such that nobody seems to know who it is.

Seems absurd on the face of it, she got 500,000 votes. According to the pro government folks on TV there are never more than 12 people at a PDRC rally,i'm sure they wouldn't lie. Assume that all 12 people voted for her, subtract from 500,000, if she's still ahead, done and dusted.

Additionally, the "June Group" is worth remembering who they really are, Anti-Monarchist Red Shirts.

BTW how many did actually vote in the senate elections here in the Bangkok 'province' ?

Probably around 800-900,000 voted.

Of the top 2 vote getters, Khunying Jaruwan received 512,600 votes, which far outpaced her closet contender, a Police Major-General, who received 248,264 votes.

The above numbers were released by the EC with 94.8% of the vote counted.

Congratulations to her and sad to see Red Shirts trying to pull her down because of some such bogus logic that what someone else said at a non-campaign rally somehow put other candidates at a disadvantage.

Yes, she was very quick to point the finger at others but isn't enjoying the scrutiny now it's on her. Lot more dirt to come out, one hopes. But these tit for tat complaints are becoming very tedious. I guess it's too much to hope for some negotiation for a solution

the red boys are getting desperate now I see coming out with all their crap in the hope of making her look bad, we really do have to wom=nder exactly what the reds said about kwanchais wife, if there were threats ussued to anyone that wouldnt vote for her, I am sure if this garbage comes off then she will be the next one being looked at.

Just boils down to TIT, anything can and will happen, the reds throw sh*t at people then claim they are not stupid when we can go to the zoo and see primates do the same thing so at least we now where the idea came from, monkeys thought of it first and the reds stole it, shows who is smarter, monkeys win hands downw00t.gif

Many years ago I remember a case where the cops captured some guys they accused of being drug-sellers. The cops took the three guys, with their hands cuffed behind their backs, into the shack where they were arrested to have them point out where the drugs were hidden. There was the sound of shots and all three "drug sellers" were dead because "they tried to grab weapons after we got them inside." No drugs were presented in evidence, as I recall. I can't remember the first name of the Police General who was in charge, but he was a Bunnag. He announced loudly that he took full responsibility for what his men had done. To my surprise he was actually charged with murder. Of course he was released on bail, so he was free during his trial. I kept checking the newspapers for the results of his trial. Finally, after about fifteen years, he was acquitted. I missed the story at first, because it was just a few lines on about page 28 of the Bangkok Post. The trial took so long because first the prosecutor presented something like 117 witnesses, many of whom could not appear in court on the date appointed and had to be rescheduled. Then the defense found that almost every court date had to be rescheduled because they had "other pressing business" that day. It could have been worse; I recall one case of alleged corruption in the sale of Royal honors that lasted twenty-five years and only ended because everybody involved died off. Thai courts have their own rules about granting continuances and excusing defendants, and those rules are not the same as in other countries. Get used to it.
