What is the legal definition of "Porn" in Thailand?

I'm looking to enlarge a pic into a poster. But I do not want to violate any laws. It is of a woman sitting on a chair in her birthday suit, viewed from behind, but turned and looking toward the camera ... so you can see both cheeks and a hint of nip. Nowhere near porn by American standards, and nothing that would be blurred / pixelated by Japanese standards.

So what constitutes porn in this country? I know the obvious, but I was wondering where the line was drawn between okay and not okay. Mainly if I were to make a poster out of it. I understand the "personal use" aspect.

I'm not too worried about the place that will make the posters, when I asked how large they can be, she showed me 3 large posters towards the back with naked Thai women covered in body paint. Viewable to any customer. So I'm sure there will not be an issue there.

In Japan, for instance, the offending idea is viewable reproductive parts, which end up blurred out. But I can not figure out what may be allowable, as I have had no luck with Google.

Its an old gag, but the difference between porn and art is the lighting. Inevitably, the image you describe will rankle someone's sense of propriety, but is it enough to get you arrested ? My guess is no, but I'm not the guy trying to sell porn here ! ;)

Thanks. I was looking for this... but now I am back where I started. I wish I knew what they meant by "obscene". My guess is that the picture mentioned above would be okay, as I have seen much worse in movies at the theater here in Thailand. However, I'd still like to find out where the line is drawn.

Any ideas on one nude woman kissing another nude woman? (Nothing graphic, of course!) I have a few gik-approved print ideas we can hang up, but she doesn't know any more than I do. unsure.png

Not sure how to edit a post, but I wanted to clarify that the main purpose of this is to procure art for my condo. But I don't want to be put in an awkward situation at the print shop if what I want printed into a large poster is beyond what would be allowed, albeit decent from my perspective. Nothing 'penetrating' the realm of tastefulness. whistling.gif

Why not just go to a print shop with a photo and ask them if they can make into a large size.

There are drawings of Thai women without any clothes on the upper body.....OK the drawings are centuries old. But doing the same now in modern technology (photos) would be illegal.

Go ahead and print, and if any Thai says it's "porn," just reply, "yes, it is a blessing, isn't it?"

That'll confuse 'em.

EDIT: Guess I better explain to those who don't know that porn in Thai means blessings.

Its easy, its whatever the official/Policeman stood in front of you says it is.

If I were you, I would take a small version of it to the local Police station and ask.

You're probably being cynical, but I think you are right.

I had this discussion with a NZ Customs officer. She said "objectionable" (which is used in NZ instead of "obscene") is highly discretionary and one officer may allow what another officer would have prohibited.

It would be hard to define it more precisely than "objectionable" or "obscene".

You may have a problem with any nipple showing. Nipples are not shown on any magazines.

If it's for your personal enjoyment in your apartment, I can't see why you would be in trouble based on your description of the photos. The printing shop will let you know if they can't do it.

Many houses have nude paintings and fake Italian statues, and the police aren't raiding these private homes.

More than 80 years old, to be more correct.

Topless ladies were normal until the 1940s.

If it upsets any of your Thai visitors, it is porn. If not, you are in the clear! I know that does not help, but a Thai lawyer told me something to that effect for a similar question. The good thing is, you can upset as many falangs with it as you want, and so long as the Thai cops are not offended, the upset Falangs will be seen as wasting the cops time by bringing them around to see it.

Checking out your Maxim link has played havoc with my blood pressure and who knows? Perhaps one day if I win the lottery I could afford one of those models for myself. Dream on baby.

I would say that the OP`s photo considering he mentioned shows some nipple is somewhere between what could be described as art and soft porn and borderline legal. It really depends on where the OP decides to display the poster. If in the home than most Thais would see this as inappropriate, not befitting and in bad taste, especially where farangs are concerned as Thais believe we are all sexpats anyway. Another point if something like this were displayed in an art exhibition, sold in a store or market in Thailand, than my guess is that it would be considered illegal or at least what could be described as falls under fine law.

This is really up to the OP`s discretion and whether or not he feels it`s worth the effort and living with the uncertainties regarding this so-called classic piece of work.

A good guideline is, whether an image would be acceptable to be publish here on Thai visa, if not, than I think that answers the OP`s question.

Once the Junta has finished sorting out Visa trangressors they can then move onto other longstanding criminal code violations and thus satisfy the many TVF moralists who sit in judgement on their fellow posters.

Section 286 Any person, being over sixteen years of age, subsists on the earning of a prostitute, even it is some part of her incomes, shall be punished with imprisonment of seven to twenty years and fined of fourteen thousand to forty thousand Baht, or imprisonment for life.

Any person has no other apparent or sufficient means of subsistence, and:

  1. Is found residing or habitually associating with one or more prostitutes;
  2. Takes board and lodging, or receives money or any other benefit arranged for by a prostitute; or
  3. Take part in order to help any prostitute in her quarrel with her customer,

The provisions of this Section shall not be applied to any person who receives maintenance from a prostitute who is bound to give maintenance according to law or morality.
