Former Thai Rak Thai party member gets 3 years in prison for attempt to bribe court

BANGKOK: -- A former police chief of a police station in Nakhon Pathom province was sentenced to three years in jail after he was found guilty of trying to bribe a Constitutional Court judge to rule in favour of the defunct Thai Rak Thai party (TRT) in 2006.

The TRT party was facing dissolution after it was charged for violating electoral laws during the 2006 general elections.

In the trial today, the Criminal Court said Pol Col Charnchai Netirattakarn, former superintendent of Pho Kaew police station in Sampran district of Nakhon Pathom approached a Constitutional Court judge, M.R.
Krairirk Kasemsan, twice at home and office during October 16-22, 2006 offering him 30 million baht if he could assist in helping the party not to be dissolved.

The attempted bribery was rejected by the judge who later filed report of the attempts to the chief judge of the Supreme Court saying he was first offered 15 million baht at office, and later 30 million baht at home to help TRT escape dissolution ruling.

The Criminal Court said M.R. Krairirk was a well-respected law lecturer and had engaged no dispute with the bribe giver before.

The court said what M.R. Krairirk had testified in the court about the attempted bribery was factual evidence while the attempts of the police officer was considered an act of selfishness, and affected the image of the court which is the last institution where the people can depend on.

It then ruled the officer guilty and handed down him three years in prison without suspension of jail term.

The former officer was a former classmate of former Prime Minister Somchai Wongsawasdi at Thammasat university’s Law Faculty. He resigned from police office to help activities of the TRT party.

Thai Rak Thai party under the leadership of ex-Premier Thaksin Shinawatra was dissolved on May 30, 2007 by the Constitutional Tribunal for violation of electoral laws, with 111 former party members banned from participating in politics for five years.

The party’s senior executives have been accused of hiring small, little known parties to compete in the election in order to help the party avoid the requirement for a minimum 20 per cent of eligible votes for candidates standing uncontested.

Such acts were considered violations of the election law.

But please let them speed it all up a bit and get more of the high placed ones.

Though some so called "Yellow Shirts" no doubt did do some wrong doing nice to see they are going for the real criminals first, even if it taking a long time.

Former police officer jailed three years for offering bribe to Constitutional Court judge

BANGKOK: -- The Criminal Court Wednesday jailed former Tambon Phokaew police chief Pol Col Charnchai Netiratthakarn for three years for offering a bribe of Bt30 million to then Constitutional Court judge ML Krairirk Kasemsan to help the Thai Rak Thai Party in the party dissolution case.

The court noted that Charnchai had twice attempted to bribe Krairirk and while the money was never paid, the crime had been committed.

The court said that Charnchai's claim that he was joking was not reasonable because he went to see Krairirk twice even though he had never previously visited the former constitutional court judge.

The court noted that Charnchai also told Krairirk that he owed a debt of gratitude to 'Khunying Or', apparently referring to the then wife of former prime minister Thaksin Shinawatra, former Thai Rak Thai leader.

Charnchai said he would appeal against the ruling.

Are you suggesting no "yellow shirts" have been imprisoned and that there is some kind of bias in the "order" that people are charged, sentenced and imprisoned?

If so, your sarcasm is misplaced and inaccurate.

I am absolutely dumbfounded that this would happen in Thailand let alone a political party member , of course there is always corruption suspicion but nothing ever seems to surface , an unfortunate got caught , dozens get away with this sort of corruption daily because both parties to the bribe are corrupt, in this case only one was.coffee1.gif

Yes, no doubt they did. The founder of the yellow shirts was tried and convicted of crimes very similar to TS. The founder of the yellow shirts was given a stiffer sentence and bigger fine than TS. This all happened since PM Prayuth took over.

I think the judge should be congratulated, this yellow, shirt red shirt discussion is reactionist pointless and out of place, an honest judge turned down 30 million Baht and reported the matter and a conviction was obtained. How many of us would honestly turn down 30 million. yeah everyone here right.
