BANGKOK: -- The Finance Ministry has been instructed to file civil lawsuit against former prime minister Yingluck Shinawatra demanding compensation for damages inflicted by the failed rice pledging scheme, said Deputy Prime Minister Visanu Krua-ngarm today (Wednesday).

Meanwhile, the Commerce Ministry will file similar lawsuit against former commerce minister Boonsong Teriyaphirom and 20 other associaties in connection with the rice pledging scheme.

Dr Visanu chaired a meeting Tuesday with representatives of the Finance, Commerce and Agriculture ministries to consider a recommendation from the National Anti-Corruption Commission that civil lawsuits be filed against all those responsible for causing damages to the rice scheme.

He explained that it was the duty of authorities concerned to follow up with the NACC’s recommendation and whether those held accountable for causing damages to the rice scheme would be found guilty or not would depend on the court’s judgement.

Regarding the criminal litigation against Ms Yingluck for alleged dereliction of duty in the management of the rice scheme, Dr Visanu said that the special panel of the Supreme Court’s criminal division for political office holders would decide on March 19 whether to accpt Ms Yingluck’s case for consideration or not.

It's doubtful that anyone in the government wants to see her jailed... it would create too much sympathy for her.

The court cases will drag on for years, and in the meantime she will be out of the game politically.

There are losses as in money spent incorrectly, unrealised income, etc., etc.

Government Officials (which includes PM and cabinet members) can by law be held responsible for losses as in money having spent inappropriately or for losses by sales at loss making prices.

So, shall we leave it at that or shall we continue with a few more charges for Ms. Yingluck for causing protests causing economical damage, Abhisit not giving in to protesters in 2010 causing losses, or Somchai in 2008, Thaksin in 2006.

It was never a subsidy for poor farmers - don't you know poor farmers don't sell rice, they eat everything they grow, even worse if they have to pay rent for the rice farm.

It was always a scam by dream up by TS to make sure his sister was elected PM so that she could change the laws to get him back to Thailand and reclaim his frozen money by giving him a pardon. ( Taksin thinks - PTP follows )

It was never a subsidy - subsidies are in the general accounts and are able to be checked by officials and politician.

This scam was off the books to be run using a revolving fund and to be paid back

Fools, horses and those who keep on telling little white lies.

If only the RPPS had been a subsidy with a 100 billion Baht budget in the National Budget, that would be normal procedure, defendable.

Unfortunately Ms. Yingluck (or her brother) thought to have stumbled over the ideal (Ponzi) scheme. Self-financing as well. Let a state bank setup a 'revolving funds' of initially 440 billion Baht, pay out from it and let revenue flow back in from sales. How sad it didn't work, how sad she said to listen to concerns, but did nothing (except change her MoC, old one also being in the hot tub with her now), how sad she stated to be in charge.

The current govt will never admit it but it's highly unlikely anyone will ever see any jail time if ever convicted of crime XYZ...the criminal judicial process will just drag out forever or the accused will slip out of the country. So, the current govt is probably thinking let's just make it easier for anybody to sue/file civil lawsuits against Yinluck and her associates which will hopefully cause them many years of pain and money spent on defense lawyers and payoffs.

A protest by farmers that lasted for days at the Indochina intersection in Phitsanulok has ended in tears.
After claiming they had been pressured by intimidation, the farmers dispersed Tuesday evening and had no idea when long-overdue payments from the government's rice-pledging scheme would arrive.

"We don't know what to do next," Siraprapha Kukhong, 49, one of the protest leaders, said yesterday.

Another protest leader, Chatree Ampoon, could not be reached for comment following reports that red shirts and officials had intimidated his wife over his participation in the protest. "She called him about the threats she faced. He was overwhelmed and cried. Many of us cried with him," Siraprapha said.

A number of local farmers began their rally at the Indochina intersection on Monday to press for payment from the government's controversial rice-pledging scheme. In recent months, the scheme has repeatedly postponed the payment to farmers, many of whom had to turn to loan sharks to cover their living expenses.

Some farmers who had no one to borrow from ended up committing suicide.

So the law suits will continue until they finally force her to leave the country.

The case against her is not about corruption! It´s about neglection.

Actually the charge should be 'gross negligence' which is much worse than 'negligence' because it is a conscious decision to ignore something. I found this in the definition: "It is more than simple inadvertence, but it is just shy of being intentionally evil." which I think sums Yingluck up perfectly.

Ah, but that would be the version of justice explained to her by her criminal brother. The one where no Shin is ever guilty of anything and lying is ethical.

This is looking like real justice where she might actually be questioned and have to say something truthful, if she can remember.

The Office of the Ombudsman has stepped up pressure on Prime Minister Yingluck Shinawatra to heed its recommendation that former Prime Minister Thaksin Shinawatra's passport be recalled, Ombudsman spokesman Raksakecha Chaechai said yesterday.

The Ombudsman's Office submitted a recommendation on September 13 last year that the Foreign Ministry review Thaksin's passport status, as issuance to a convicted felon was illegal.

The Foreign Ministry, which must respond to the Ombudsman within 30 days, in mid-October requested another 30 days to collect information on the issuance.

Since it had not heard from the Ministry since, Raksakecha said his office on Tuesday submitted a letter to the PM asking her to instruct the Foreign Ministry to heed its recommendation.

If the Foreign Ministry ignores or rejects the recommendation, Raksakecha said, the Ombudsman would report the matter to Parliament in order to obtain a full disclosure of the regulations on passport issuance, and whether the ministry had followed these regulations.

Two years on and no-one has obeyed the Ombudsman,s request - how unusual for anyone from PTP

Rather doubtful your comment and compassion will impress anybody.

Ask around and you'll find many Thais who are tired of all the corruption and nepotism and ready to see some action to punish those responsible.

Also relevant, there can be no doubt that Thailand needs to get more serious about respect for obeying the law and proper / fair application of the law, demand higher morals and ethics from it's leaders, demand transparency etc. Until this happens nothing much will improve. As obvious as the nose on your / my / everybody's face.
