7 Month Overstay Pls Help

Hi All

I'm hoping you guys can help me, I'm currently 7 months over stay and had a 30 day visa at the airport when arriving in Bangkok, I want to fly out to Singapore or Malaysia to correct this problem. I know theres a 20,000 Baht overstay fee but I heard a lot of rules have changed at the start of April and I will get banned for 1 year as I'm over 90 days. I then want to stay out of Thailand for about 2-3 weeks before flying back into Bangkok will this be a major issue?

I know I will get a lot of hassle from fellow members but I had a huge personal problem which is now sorted.

There are no 30 day " Visas" you were provided with a visa exempt entry.

You will not be "banned"

Whilst outside Thailand obtain a VISA appropriate to your needs before returning and then stick to the conditions of that visa.

Thanks for your feedback, whats the best place to fly too as I want to get a family O Visa for my return back into Thailand

Do you qualify for such a visa ?

By marriage to a Thai person for example ?

If you are named on the birth certificate then you might be able to obtain a 90 day visa but that will be all unless you are the "legal" father of the child.

Yes I'm on his birth certificate as his father, looking at other posts seems Laos is the best place to get my visa ?

being on the birth certificate does not make you the legal father, for that you have to go to court. But you can try the amphur first, together with mother and child. Most will allow you to become the legal father at age 7, but some do it at age 6 or even younger. Might help if you have a school teacher or the headmaster vouch that you are the father of the child.

This isn't about who the biological father. He can be the biological father, but not the legal father.

If he is not married to his son's mother he is not automatically the legal father and has no legal rights over the child. If he wants to be recognised as the legal father he needs to marry the mother, or apply for legitimation as advised by Mario2008.

The best way is by air.

By road there is always a chance of being stopped on the way to the border.

As long as you make it to the border, and can pay the fine you want have a problem either way.

Your only potential problem is getting caught, on an overstay, by the police before reaching the border. If you are caught, saying you're on the way out of the country will not likely help you, and you will probably be arrested, and put through the deportation process.

If I were you I'd exit from the closest border.

Depends also a bit from where your starting point is.

Are you (very) near a land border crossing, or is a airport with International flights or a airport with easy connection to a Airport with International flights near you?

If you have to use or could use, first a domestic airport to get to a International flights airport, it should also be no big deal,

usually they look only your name page at the passport at check in and security control.

BUT, to avoid any problem there,

(unsure if a Passport copy would be a possibility - your Passport could be in your Embassy to getting a new Passport or in a different Embassy to get a Visa)

just CHECK IN - Online and print your bording pass in any suitable place and you do not need to go to the Check In counter at all. (If you have no check in luggage - even than you just drop it off at the special luggage drop off counter, which does not check your details much more)

You can do that ONLINE CHECK IN, also for most International flights with bigger airlines.

I just did that 12 days ago,

Made myself ONLINE Check In for the Bangkok Air flight from Udon Thani - to Suvarnabhumi and also

ONLINE Check In with =SWISS= Airline to Europe in Suvarnabhumi and could go directly to the Passport control with my 7 days Overstay I had.

Doesn´t matter where you try to leave the country, they will catch you anyway and charge you 20.000 baht and you will get banned for 5 years.

The only way to not get banned is to go to immigration and turn your self in, if you just try to leave the country means they catch you will overstay and then you will be banned.

This is what they wrote with the new regulation.

Until the OP reaches the desk of an immigration officer at a border he is a risk of arrest. IMO having a booked ticket or being checked in doesn't help if caught.

The new regulations have not come into law yet so he won't be banned for 5 years.

and without approaching the Check In desk of SWISS in Suvarnabhumi,

so with nobody from importance looking into my Passport,

to get to the Thai Airport Immigration.

(except the short security name check when go inside the departure airport part of airports)

Some people, I was reading here on Thai Visa are already fearful from the domestic flight leg to Bangkok on their way out. thumbsup.gif

That are, from me visited Thai Embassy -Consular sections

and I will stay away from them if its possible.

Singapore was rude

and unhelpful and did not provide me with a Non Immigarnt -O- you like to have, they wanted more than a birth certificate, wantes a proof of staying there - I am also a father from Thai children and not a legal father.

In Kuala Lumpur, it was some years ago - do not know today, overcrowded, so far you had to sit on the floor,

on the end of 2,5 hours waiting, I did not get a Visa, my Passport's last page was not enough free room for them.sad.png

and in Phnom Penh-Cambodia possibly the most fun when waiting for the Visa. rolleyes.gif

In Phnom Penh, Siem Reap or at the beach in Sihanoukville you have, under normal circumstances the possibility to get a Tourist visa from the desk of your Hotel with a Visa agent, costs about 50 Dollars.

The extended waiting time of 3? days there is for me a nice holiday, for others a pain in the ass.tongue.png

That Visa you can extend in TH after 2 month, for another 2 month, same a Non Immigrant -O- after 3 month for 2 month for having Thai child.

BUT, I do not know, in you special long overstay circumstances,

how they like there to give you a Tourist visa, or maybe not. whistling.gif

A Non Immigrant -O- you have to apply for yourself in PP.

Of course, you can possibly also only come back after some days and get 30 days Visa exempt entry allowance and can extend that than for 60 days - for having Thai child and staying with it.
