dasboot Posted May 17, 2015 Posted May 17, 2015 My Non O visa is due for renewal in June,I am married to a Thai and have a two year old daughter, unfortunately my wife is in prison and will be when i need to renew,i am currently taking care of my daughter on my own,i intend to stay with her and my daughter when she is released. The problem arises in the fact i can’t get her to sign the copy of her id and house book so my options appear to be limited if i have any at all,any advice concerning my visa options ?
ubonjoe Posted May 17, 2015 Posted May 17, 2015 You should talk to your local immigration office about doing the extension based upon being the parent of a Thai since you wife will not be able to attend when you apply for your extension. Take along some proof that your wife is incarcerated which for all intents and purposes means you are now acting as a single parent. Edit: I wrote the above thinking you had an extension of stay. If you have a multiple entry non-o visa then you may have no choice other than getting a single entry non-o visa for being the parent of a Thai and the apply for a 60 day extension to visit your child.
bigt3116 Posted May 17, 2015 Posted May 17, 2015 Would it be possible to get your wife to sign paperwork on your next visit to her ? (I don't know if visits are contact or not).
KhunBENQ Posted May 17, 2015 Posted May 17, 2015 i can’t get her to sign To me that sounds like she is not willing?
dasboot Posted May 17, 2015 Author Posted May 17, 2015 Visits are non contact,i asked in the office and got told it was not possible for her to sign, even through a solicitor its not possible,so its not a case of her not being willing which she is,its the prison rules, regardless of the outcome.
PoorSucker Posted May 17, 2015 Posted May 17, 2015 Talk to your local immigrations office if you can get extension based on being a parent. Normally the wife must come with you to sign papers at immigrations. Also the extension for marriage Must be de juro and de facto, that means that you must live together as man and wife.
ubonjoe Posted May 17, 2015 Posted May 17, 2015 Visits are non contact,i asked in the office and got told it was not possible for her to sign, even through a solicitor its not possible,so its not a case of her not being willing which she is,its the prison rules, regardless of the outcome. That does not sound correct to me. I would think her solicitor could arrange it. If you have a multiple entry visa you can do another entry just before it expires (enter before date) and get another 90 day entry. You could also get a 60 day entry to visit your child at immigration.
dasboot Posted May 17, 2015 Author Posted May 17, 2015 ubonjoe you are most right about the solicitor but on the day in question they were not being very helpful and i gave up,saying that i didn’t talk to the solicitor, which in hindsight was the correct course of action, i let that slip after the visit to the prison office. My last 90 days is up so i need a new visa,is it possible to get a Non O single entry from Savannakhet based on taking care of my daughter ?
ubonjoe Posted May 17, 2015 Posted May 17, 2015 Before going out for a visa you should apply for a the 60 day extension to visit your child. You will need to take your child with you when you apply. You will need their birth certificate plus a copy and a copy of their house book registry. You can get a single entry non-o visa at Savannakhet, Vientiane or Penang based upon being the parent of a Thai. Same documents as for the 60 day extension.
dasboot Posted May 17, 2015 Author Posted May 17, 2015 Many thanks ubonjoe, just one more thing,in all the years i have been here i have never been to a immigration office,i have always had Non O multiple entry visa with its 90 day visa runs,so what is the procedure for my trip to immigration, other than what is in your post.
ubonjoe Posted May 17, 2015 Posted May 17, 2015 The procedure will vary from office to office. You will need a completed TM7 application form with an attached 4cm X 6cm photo. Download and print 2 sided. http://www.immigration.go.th/nov2004/download/pdf/tm7.pdf The fee will be 1900 baht. They may also want proof of residence unless you are living where you child's house book is for.
dasboot Posted May 17, 2015 Author Posted May 17, 2015 I have my yellow house book, but my daughter is not in the blue house book,i take it i need to get this updated. ?
ubonjoe Posted May 17, 2015 Posted May 17, 2015 Your yellow book is good for proof of residency. Your daughter should be in a house book already, That is done when the birth is registered.
dasboot Posted May 17, 2015 Author Posted May 17, 2015 Thanks ubonjoe,i have the blue book in front of me i was waiting for someone to come home to translate it for me,the last entry date matches her birth date so i reckon its her and just so i get the form right, the arrived by,port of arrival section is when i arrived in Thailand [not by motor bike to the office haha].
MobileContent Posted May 17, 2015 Posted May 17, 2015 ubonjoe you are most right about the solicitor but on the day in question they were not being very helpful and i gave up,saying that i didn’t talk to the solicitor, which in hindsight was the correct course of action, i let that slip after the visit to the prison office. My last 90 days is up so i need a new visa,is it possible to get a Non O single entry from Savannakhet based on taking care of my daughter ? When is your last visa up? My O-M visa expires on the 9th of July so I am going in and out on the 7th to get another 3 months and I can also extend it for another 60 days so I am fine until early December.
MANICMINER Posted May 17, 2015 Posted May 17, 2015 If you have an old copy of her id card and housebook with her signature on it, you can get a one year multiple entry visa in savanakhet. I have done it on two occasions with just an old photocopy.
