Dear All,

I am after some advice. I have everything I need for the Spouse visa, except hit a snag on the accommodation front, when speaking to my landlord( its a very big agency in London), they told me that I can have whom I like staying at the property with me, however they will not write a letter stating that as it is not their policy to get involved in immigration issues ( apparently it has been this way since 2011). They said my rental agreement has all the property info including the size so I just should send that. Obviously I know this isn't going to fly to with ECO so any ideas for options? Ort supporting documents that would be acceptable?

My Mother ( who owns her house) has said that she is more than willing to write a letter saying that we can live with her and provide mortgage details. Would this be the best option? however as I do not currently live there would this be a problem?

Also do I need to provide details of my Husbands job in Thailand?

Thanks as always,

Nina

Such a letter is not mandatory. There are various ways to demonstrate that the accommodation is adequate. If, as the landlord says, the contract gives the size or number of rooms, then that should be fine. You can provide photos. If you have a Council Tax Bill stating that you receive a single person's discount, then this is evidence too. After all, you only need one bedroom in the accommodation.

A copy of the lease should clear that up.

As far as I am aware, unless the lease specifically states that only one, named person may live in the property, there would be no legal cause for a landlord to forbid a tenant's spouse or partner taking up residence.

Whilst a landlord's letter can help, it is not, as TVE says, essential. ECOs usually take the sponsor's word for it; unless they have reasons to doubt the sponsor's credibility. In which case they may ask for a letter from the landlord. But they are aware that many landlords are, for some reason, reluctant to provide such.
