Hello ThaiVisa, I know it seems like I only come to you when I need something!

I had a bit of a nightmare with my (now) wife's UK fiance visa application due to an inept agent so I'd really like to start a thread for guidance with filling in her application for the FLR so there are no issues this time. She got her English Language certificate on the 2nd April 2015 which was 4 days before the cut off before the system changed so we have to get her application in correctly before the 5th November.

So here goes, some will be very basic questions just to be absolutely sure so please bear with me.

We moved to UK in July 2015, she came here on a Settlement Marriage visa (aka 6 months fiance visa). We married earlier this month. I believe the next step is to apply for a FLR(m) now, right?

2.2 Is this the first time you have applied for a visa or extension? - YES

2.3 First period of leave to remain - YES

You are making a first application from within the UK but have no previously had leave to enter/remain as a partner. - NO

12.5 Have you enclosed the current Passport for a dependant? - our two kids have British passports. Is this what this is asking for? Or is it for dependants who are also applying at the same time?

Do we have to apply for the Biometrics registration separately or is it applied for when the FLR form is submitted through filling in section 9?

I'm going to write a letter of sponsorship as I've always done for every visit and fiance visa we've ever applied for. Does my wife also need to write a covering letter? She has always done one previously in Thailand.

Do we need to supply all of the Thai based evidence that was required when applying in Thailand, such as Thai Bank accounts, Tabian Baan, Thai ID card?

How do you submit all of the paperwork by post? Do you section all of the additional info into a folder, paperclip it all together or just include it all loose and let them figure it out?

2.2 is no

You have previously applied for a visa

The full question is

"Is this the first time you have applied for a visa or extension of stay in one of the above categories (including previous leave granted as a fiancé(e) or proposed civil partner) with your current sponsor? "

So this is the first time we've applied in this category, right?

Not sure now. I did a search on here and it said the answer is no. I don't know now.

I think 2.2 is referring more to any previous visa application with the sponsor. Which is no, this not the first application

So does anyone have anything to confirm the answer for any of these questions above??

Going through the application it seems like they must know that the questions are worded in a very confusing way.

She has only been here 3 months so has nothing in her name at the moment. Can I ask what you are planning to submit regarding that question?

I'm still not sure of the answer and I hope someone who reads it in here can help.

The way it says "including previous leave granted as a fiancé" makes me think that we have already got a fiance visa together before so the answer should be "No, this is not the first visa in this category we have applied for".

Anyone have any idea.about any of the questions in the first post?

What do I put for this question?

"Is this the first time you have applied for a visa or extension of stay in one of the above categories (including previous leave granted as a fiancé(e) or proposed civil partner) with your current sponsor?"

She came here on a settle marriage visa (aka fiance visa), we married earlier this month so this is the first FLR(M) application.

Also, is the FLR(m) the correct visa for our situation btw?

She is also on my council tax bill and has a provisional driving license with our address on it.

I only have a council tax bill with both of our names on it. I'm also submitting letters from my bank and bills addressed only to me.

And for her I'm submitting letters from her new UK bank, an invoice that came with the ASDA online shopping delivery she does, a new mobile phone bill, and a copy of her driving license. I'm also sending in a photo of us all standing in front of our house showing the house number.

How did you get driving licence ? Don't you need a NI number and UK passport to register on the government gateway system

How did you get driving licence ? Don't you need a NI number and UK passport to register on the government gateway system

No, I think I just used the council tax bill as proof of address. I just posted in the application with her Thai passport.

So I found the answers to most of the questions in my OP and the rest I figured out for myself.

For 2.2 "Is this the first time you have applied for a visa or extension of stay in one of the above categories (including previous leave granted as a fiancé(e) or proposed civil partner) with your current sponsor?"

The answer should be "NO" because she is currently on a fiance visa.

Therefore the answer for 2.3 should be "First period of leave to remain (following an initial period of entry clearance as a partner of a settled person, or following an initial period of entry clearance as a fiancé(e) or proposed civil partner of a settled person - 6 months)"

I'm not submitting any of her Tabian Baan or house details, or her Thai ID card. I am submitted her Thai passport and her translated bank statements from her Thai bank showing support from me which I will highlight each transaction.

I'm submitting our children's Thai birth certificates and passports plus their British registrations and British passports.

There is over double the amount of documents from me than her, I assume this is normal? I've put a printed out index of the documents she is submitting and all of those docs or in a plastic folder. Then I have a printed out index all off the documents I'm submitted and they are sectioned into different plastic envelopes too. I assume this is all OK?

I'm a bit paranoid about how many times the application says "If you do/not this then your application will be rejected", so I really hope I've everything correct with the application and given them no reason to reject the application on a technicality about the form or format because if it is rejected then the time limit for her English certificate will have passed for any further application.

I'm going to post the application tomorrow. Any advice greatly received at this time! :)

It all sounds good. I think errors in the application can be understood. As long as the mistakes aren't by ticking the boxes such as have you been involved in a terrorist organisation

As long as you prove your relationship and earn enough money then if any mistakes they can ask for further documents/details. The money part seems to be the biggest reason for rejections.

As you're are on a fiancé visa, the lack of papers in your wife's name can be understood, a little note making this point wouldn't go a miss. Whereas I'm applying for flr(m) after 2.5 years. Therfore, should be able to include more documents.
