Law Society talks possible appeal with Myanmar envoy

BANGKOK: -- MYANMAR’S AMBASSADOR to Thailand, U Win Maung, yesterday met with Law Society president Dej-Udom Krairit to discuss an appeal in the Koh Tao double-murder case. Two workers from Myanmar were sentenced to death last week for the murder two British tourists on the island last year.

Dej-Udom said the Law Society had set up a committee to scrutinise the court's verdict, but the association might not be able to file an appeal within 30 days after the sentence was handed down. The lawyers might seek the court's permission to extend the time frame in order to help them understand the verdict, he said.

Thousands of Myanmar people staged rallies in their homeland after the Samui Provincial Court handed the death penalty to Zaw Lin and Win Zaw Tun for the killing of David Miller, 24, and the rape and murder of Hannah Witheridge, 23.

Key officials in the Thai government - notably Deputy Prime Minister Prawit Wongsuwan - have said they believe the protests in Myanmar and other countries such as Sri Lanka and Malaysia were manipulated by Thai people who dislike this country's military-led regime and its junta.

The verdict was not final. The two defendants have a chance to appeal for a reconsideration by higher courts. It could take one to three years for the Appeals Court to reconsider a verdict of the primary court, Dej-Udom said.

The Law Society's team has made 26 trips to the murder scene on Koh Tao. Its lawyers provided pro bono legal services for the accused.

According to Dej-Udom, the ambassador said he would ask for the government's financial support, pending a report from the association.

The association also plans to seek the court's approval to bring the two convicts from Surat Thani prison to a jail in Bangkok, to facilitate the legal process.

Meanwhile, Thai Ambassador to Myanmar Pisanu Suvanajata met with Myanmar Foreign Minister Wunna Maung Lwin in Nay Pyi Taw on Tuesday to explain the legal procedures in the case. The Thai envoy handed the minister copies of the Thai court's verdict in English and Burmese in order to have Myanmar authorities study it.

The minister told the Thai ambassador that an appeal would be made step by step in accordance with the procedures of the Thai judicial system, according to state-run newspaper The Global New Light of Myanmar.

The Myanmar government is working closely with its embassy in Bangkok and the Thai Law Society, the paper said.

But. But. But. 98.2% of the Thai people are happy with the Junta. Wherever did they find anyone who dislikes it?

He was arrested after evidence which police collected were examined and proved he was involved, he said.

........

He also dismissed any suggestion of local mafias or influential people that could twist the investigation with promise that local influence would pose no obstacle to the police investigation.

Instead the police will eliminate all these mafias, he said.

Strange case....

Oh dear! Seems things aren't all rosy in the land of frame- up.....

Unless the B2 get real lawyers, who really fight for them (and not only are part of the dog and pony show), sadly it will not make any difference...............coffee1.gif

Trust that if ever Thailand is invaded by one of their neighbours the military committee selected is a bit quicker off the mark in deciding who / what the problem is......

He was promoted as Maj General to Assistant Commissioner General of the Royal Thai Police and transferred to Bangkok. He was replaced by Maj Gen Decha Budnampeth, Deputy Commissioner of the Central Investigation Bureau, and a former provencial police chief in Phuket (2006-2008).

On a daily basis, this current administration demonstrates not only how out of touch they are, but also their extreme level of incompetency.

Key officials in the Thai government - notably Deputy Prime Minister Prawit Wongsuwan - have said they believe the protests in Myanmar and other countries such as Sri Lanka and Malaysia were manipulated by Thai people who dislike this country's military-led regime and its junta.

Can one even begin to imagine where the minds are at, that either utter such statements, or are told to utter such statements? Is there a single individual, either Thai or foreign, in this entire country, that finds an imbecilic statement like this credible? Is this the ultimate example of refusing to take any responsibility, or on any level being accountable to the people?

Why would the Burmese people be upset with us? We are very good neighbors. We treat migrant workers so well. We make their entire stays here so pleasurable. From the simplified and inexpensive work visa process, right down to the favorable status we give them, the fair wages we pay, the nice living conditions we provide, the free health care, and a multitude of other ways we take care of them, we make their stays here a absolute cake walk. And our judiciary is so fair and competent. How can they be upset with this verdict? How on earth can they possibly think these guys were framed, or were set up as patsies? Why would they think that? Don't they know that we are such good guys, who are running the country? Don't they know how fair and impartial the Thai judiciary is?

There is such misunderstanding here. Perhaps they do not understand our history. Anyone who studies our history will understand us, and know how good we are. We have nothing but the noblest intentions. Profit and maintaining power are never motivating factors with us.

Lastly, can one even begin to imagine how frustrating it would be, to be a member of this Thai Law Society? It would be akin to being a member of a democracy league in North Korea. Or an anti whaling committee in Japan. Or a consumer protection banking agency in the US.

If the chance to appeal the verdict takes longer than 30days then I think there will be no chance for justice to be served. The boys will be exicuted quickly.

Wish all Happy New Year with granted freedom to unfortunate and most likely innocent convicts and the real and true new investigation to find the real culprits of this horrible crime on British tourists without these nonsensical statements by police like "Thai couldn't do it".

The face book article and the other article from sept last year that police had evidence to implicate Mon and otheres also CCTV footage has strangely dissapeard from the radar.

Wasn't a high ranking police officer re located for saying this..

I have always thought that the B2 saw more than they let on, I think the defence for the B2 was poor at the least, nothing was said of the police report in the news involving Mon, nothing was said of the fighting in the bar the whole case a shambles.

The B2 should speak up if the face book article is true, their lawyers should be calling for protective custody as they will be terrified to speak out as they may end up committing suicide in prison.

The DNA shambles alone should see the B2 released on Bail immediately, the Thai police should be held accountable for the loss of DNA , the case should be thrown out today.

If the real perps are caught (I think British police would have to hand over DNA if they have it) then many heads will roll as we now have a situation that has become diplomatic, between Burma and Thailand and a Prime minister that calls protest to a sham and bungled investigation that may end in the execution of 2 scapegoats a conspiracy against his government.

To the Burmese administration, call all your people home.

They will continue to be scapegoated for crimes committed by Thais, surely you have had enough of this by now.

WOW,

After reading this, I am more convinced that this is what really happened, than anything the RTP has stated about this case.

Been in and out of Thailand for the last 20 years, I know this is how they work.

And as a Thai Policeman was involved in the murders, the clumsy, incompetent investigation, straight out lies and Burmese

scapegoats, it all makes sense.

These Burmese boys need access to fearless experienced defense lawyers whom can turn this case upside down and expose the truth.

I think if they did execute them there would be more demonstration possibly be the thai embassy burnt down

I dont believe this at all.

The Bangkok bombers have so far escaped death.

In fact , there hasnt been a 'lethal injection' since 2009.

This case will go on and on with appeal after appeal for a very long time....

I find it hard t believe that a conspiracy of this magnitude exists but I think the original DNA of the semen should be retested and made public.

Given the evidence as presented in the public domain by experts and the police, there is no way that the prosecution could realistically prove "beyond reasonable doubt" that the two accused were guilty of murder. Meanwhile, it is possible that the murderer(s) could still be on the loose. Bottom-line, has justice been served?

A couple-three divisions of Montagnard could probably overrun the Thai military with muzzle loaders and pellet rifles.

I worked with the RTA, RTMC & RTAF over a decade off and on, so I'm not just talking out of my buttocks here.

Has to be the most indecisive military I have ever worked with as a defense contractor. They have LOTS of 20-50 year old tanks & Humvees, and maintenance is non-existent.

The RTMC impressed me though. They seem to be the only professionals. I loved working w/ those guys.

Chinese submarines would solve everything. crazy.gif

===========

Back to the topic at hand, I'd imagine the B2 will get a reduced sentence on appeal, maybe 30 years, and get shipped back to Burma in 15 years, if they are lucky.

Poor guys were just in the wrong place at the wrong time.

Of course none of us knows all the facts, but from my perch, I see reasonable doubt out the wazoo.

30 days to FILE the appeal. Not 30 days for it to be adjudicated.

The appeal process will go on for years as those young guys become hardened criminals, cursing the world in a Thai prison.

I know a large percentage of any and everybody (aside from the Thai courts) think they are innocent.

I wonder if there is any way we could all send them 20 baht a month?

They'd probably be worth more than Thaksin & Prayut combined if we could.

Every time the prime minster talks it gets scarier. Now the world is against the Prime Minister

There are elements that are trying to subvert Thai Society and its outside Thailand

To me honest with you I don't think the rest of the world really cares that much to sage

Demonstrations against the Prime Minister.

As it is the time of year for predictions, this is my prediction for how this case will end..... Death sentence commuted to life imprisonment and after serving five years or less the B2 will be released and deported back to Burma.

Meanwhile; the real culprits will evade true justice until hopefully karma catches up with all of them, including all the corrupt Police involved in the case.

Every time the PM speaks it gets more hilarious... to a foreigner.

I cannot speak for the Thai people, but to those that pay any attention, it is probably far more bewildering and worrying than funny.

I do love the country, and I hope the PM has the country's best interests at heart instead of his own.

He most assuredly has not done that so far though.

The guy is a buffoon.

NOT SAYING any previous gov't was any better... Just saying that the current thug in charge is just that. A thug that clears beaches and creates bike lanes and gets angry with the press.

He's no Lee Kuan Yew.

The country is a basket case when it comes to corruption.

The entire RTP fired should be fired and forced to re-apply.

That is entirely unfeasible though, as much as it needs to be done.

Maybe, just maybe, the guy is trying to turn the tide.........I don't know. I currently doubt it.

Firing the entire RTP would be like stepping in an ant bed and chopping off your leg to rid oneself of the pain of the ant bites.

The guy DOES deserve every single bit of scrutiny and opinion though.....things he suppresses.

That Rajabhakti gig, under his rule........Who knows? Can't ask questions.

THAT, I disagree with. Farcebookers in in jail???

Other critics dying in custody????

I honestly wish and hope the best for Thailand next year and every year, but just see more of the same same but different.
