Tried contacting tothemark after reading an archived post on this subject but could not send the message ?

We are in a spot of bother with this Sor Por Kor and would greatly appreciate the name of the lawyer you mentioned in your post and any other advice you may be able to offer.

I am married with two Thai children and we have a 15 rai property planted with rubber trees - my wife purchased it from the original owner approx. 8 years ago (before I met her).

We have built a bar/restaurant with three ponds stocked with a variety of fish.

We have also built a mud brick bungalow on the property and now reside there.

Never realised what we were doing was illegal (not only buying the land but also building on it) as we regularly had top police, army and govt officials come to dinner and never anything mentioned).

Virtually every block of land within a 30km radius is Sor Por Kor land and they have been bought and sold repeatedly for the past 30 years.

Appears the Govt are coming in to survey and we may well lose our home - any help greatly appreciated,

Cheers,

BB

go to goggle and search land title/use documents in thailand. there are 6 different documents that the land offices have /can issue. it describes each, its limits, etc. match the document you hold to that list and you should have a better of any questions or problems that may arise. there is mention of other named land documents issued by some other entity but it does not say who. good luck

This has recently become a problem. I live near some mountains. The Thais have built small resorts and restaurants on these mountains. One of these people is a friend of mine and he happens to be a policeman. No break for him either. He is a hard worker and had a number of small bungalows. The government forced him to tear the bungalows down. He wasn't the only one. Years ago I wanted to buy some land in that area. My wife said that the land belongs to the government and those supposed owners have no right to sell it. I should add that over the years she has accumulated more than 60 rai. She refuses to even look at land that has no chanote.

About 11 years ago, shortly after I moved here, my wife wanted to buy some land from a distant cousin. I really have no idea what the title on it was, but it for sure was not a chanote. Anyway my wife bought the land and said her name would be put on the deed. It took about a year, but low and behold, my wife's name was on the title, and it was a full chanote title. I was amazed, but happy, as it basically doubled the price of the land overnight.

I opened a new topic on this.

Does anyone have any reference or places to read up on the government's plan to take back sor por gor titled land in 25 provinces (428 390 hectares)? It refers to restoring land under section 44 to be submitted to the council of ministers on the 14 June.

Please keep politics out the discussion. Interested in more info. Like many who have families who have this type of possesory titled land. Or whose spouses bought this land.

Maybe these can be merged. I will keep checking both this and my topic for updated posts

Just an update for anyone interested.

After many sleepless nights thinking we were going to lose our land it turns out it was nothing to do with Sor Por Kor land.

Turns out the locals have been buying and selling national park land for years and that is why the surveyors were coming in.

Live to fight another day.

Cheers,

They just made the loud speaker announcement that anyone with this type of land in our area has to present themselves with their original ID card at the amphur to gov representatives to claim their land or register on the 10 Aug 2016. It is not very clear. People with 100s of Rai are not looking all that happy. Will post more as I hear.

my mother bought 10 rai in Chantaburi and she let her brother look after it  but after time went by her brother sold it all to a local business man as for credit clearance.

i believe this piece of land is SPK land as she had no proper documents and all the area is for farming.

my suggestion

please be relaxed don't stress yourself.

Thai Gov. don't bother the people who are real farmers.

put on some crops and stop building an outstanding building or house that is eye catching.

cause people envy you.

If the paper still bears the name of your mother on the title then it still belongs to her. Names on SPK titled land cannot be changed until the death of person and only then into another family members name, legally. So I recall.

I'm talking about 30 more years ago in which i am not certain that SPK was already used at the time. As a consequence, we lost it and my mother's no longer own this piece of land because she didn't make a proper document when purchasing this.
