With the Army flexing their muscles in the area, if it is illegal maybe they will have to. However, as long as it is 50m from the beach front and no higher than 12m it is probably not illegal. Sorry for the restaurant but there is nowhere you can "buy a view" and even a two storey property would be in the way of the view from the other side of the road. The land plots in that stretch are about 60 m deep so it is possible.

then they might also want to take a look at the beach at Seatran near Big Buddha which is disgusting and a first impression for many tourists. I doubt anything will be done about it mind.

If Bang Rak is "City Zone", the Samui building regulations says: Up to 12 meters high (from ground level, that can be raised with land); 2 meters inside own land from public area, which can be public road or beach (belonging to Marine Department); ½ meter inside land from neighbor if no openings/windows; 3 meters from water (sea).

12 meter height can be 4 storey, however cannot be flat roof – some percentage need to be "Thai style" angled roof (cannot remember exactly, but think it's around 60 or 70 percent) and colors are specified in a range of "earth colors" (believe it-or not, no Blue roof tiles allowed on Samui). But perhaps the angled roof-style can be waived and all flat roof allowed..?whistling.gif

Fisherman Village for example is City Zone, that's why there are some 3-storey and 4-storey buildings at the main entrance. Often the City Zone in beach areas is declared as a number of meter each side from areas entry road; for example 100 meters or 200 meters each side, as in original Maenam village. It can easily be checked at Tessa Ban, from where also building permissions are issued. Even think it's available on-line – some poster once placed a link – so you can try Google or search Thai Visa Forum.

Quoted by memory, from when I was building a few years back.wink.png
