Farang as Juristic Manager. Any in Pattaya ?

Has any one, other than Thais, managed to get into the committee of the juristic person of your condo?  Better still, a Juristic Manager of your condo ?

 

Is it possible at all ?  Especially if you don't have a work permit.

Ahh ok I see ...so being chairman of the comittee results in a day at court and peppercorn fine but being part of the comittee is ok :D

The chairman is the person who signs on all documents pertaining to the juristic person, especially debt free certificates.

My juristic chairman and manager receives a salary for the part time work as juristic manager.

Both require a Work Permit. Not sure why lawyers would tell you different. Thai people can file complaints against farangs resulting in an arrest. Specific examples are in instances where the Juristic person caused trouble when a Thai person lied on a property transfer in order to get a commission.

btw, is it possible for the juristic person to operate a 7 Eleven ?  Since we are in a Soi and not on the main road, it's unlikely that 7 Eleven or FamilyMart would consider opening a store at our condo as a business option.  

 

I wonder if the juristic person can sponsor or operate a convenience store as a business concern.

That's the Juristic Person Manager's job. The Chairman is not really very different to any other committee member as what he does is dictated (or should be dictated) by the majority vote of the entire committee. In case of a hung committee vote he has a casting vote. If he is outvoted he has no extra say. The Chairman is basically a figurehead.

That's right. Thai law is sufficiently vague that even picking your own nose without a work permit could be considered illegal, if some Thai nose-picker complained that he had suffered as a result.

Chairman/committee member is an unpaid advisory position. Your JPM is presumably paid for being JPM, not for being chairman. He just happens to be doing both jobs, which is not a very good idea in my opinion: the more people doing the different jobs the less scope there is for dishonesty, at least in theory.

Woudnt it be better to get work permit information from the ministry of labor, rather than the land office or immigration office.

I would imagine more correct than land and immigration office as neither issue work permits.

A very small amount, which suggests  he was punished for being 'guilty' of something.

Our Complex has two Fararngs on the committee though our Chairperson is Thai.  Does not seem to be a problem.

Can you trust Thai attorneys?

 

The moment they say it's legal to register a company with Thai nominees to own and control land, I lose confidence in them.

 

Thai attorneys are not required to purchase professional indemnity insurance.

No  You dont need work permit sitting on the condo committee..

Condo management needs only to register committee members at the Landoffice and that is completely legal.

I have been on it in my condo, and before that it has been checked with Landoffice and Immigration..
