Yingluck can appeal if convicted: Wissanu

BANGKOK: -- Former prime minister Yingluck Shinawatra can appeal if the Supreme Court passes a guilty verdict against her next month, but she will have to wait until the organic law on legal procedures comes into effect, Deputy Prime Minister and legal expert Wissanu Krea-ngam said on Thursday.
 

The new Constitution allows an appeal against a judgement by the Supreme Court’s Criminal Division for Political Office Holders, Wissanu said. The 2007 charter and its organic law on the legal procedures against political office holders had already been invalidated, he explained.

 

However, the new organic law was passed by the National Legislative Assembly (NLA) only this month and it would not come into effect until passed by the Cabinet and royally endorsed.

 

There have been concerns that the former PM might not be able to submit an appeal in time if the court verdict is delivered before the law is enacted.

 

Wissanu said he believed the provisional clauses would give way for proceedings in such a case.

 

Yingluck has been accused of dereliction of duty in managing her government’s controversial rice-pledging scheme.

 

The Supreme Court’s Criminal Division for Political Office Holders will deliver its verdict on August 25.

I think in most places the Supreme court,or highest court in any country,

their verdict is final,but in Thailand they are going to be given a 5th chance

to appeal, but i think it will be only rich people who have the funds to get

that far.

lets get this over and done with and recover what billions can be recovered then go after the brother.

 

At least this government is chasing the wealth of greed previously bestowed on the Thai people. :jap:

When u point one finger three come back at you. What about Abhisit not implementing the flood mitigation program? Or the Generals nephew? Have commercial funds been secured for the many projects set out by the junta? These could be their rice programs in years to come. :clap2:

if they ever leave; which it increasingly looks like they wont; this yingluck verdict and any mob action resulting from it will provide the ideal excuse for heavy-handed reprisals by the military dictatorship; wouldnt surprise me in the slightest if they seed such mob action themselves, then sit back and say :"see, we have to stay on for national security"

And how many more years can you drag it out before you get a verdict you like?

Yes get this over and done and then go after the rubber subsidies and recover the corruption monies stolen by the military procurement and the train projects.

By buying unneeded weapons that do not talk to each other ?  By creating a caustic business environment ?  Because this all reflects badly on Thai officialdom, it will be like a terrible rash.  It will stay sore or itchy and not go away anytime soon.

Unfortunately corruption is ingrained and has been for long long time.

 

Non of which means Yingluck was negligent in the rice scheme.

So true that corruption is ingrained long long time ago. Yet prosecutions are still selective based on power, wealth and allies. If she is convicted for negligence without any legal precedent, then hoping that her case will set the precedent. Agriculture subsidies, military hardware procurements corruption, money losing rail projects and the massive handouts are prosecutable.

Every project starts off to benefit the people,  subsidy, health, infrastructure, education etc. The the locusts descend. Someone at ADB I know reckoned that they worked on the theory that between 20-30% of their funding was skimmed off. And that was in most member countries.

 

Here, there isn't the robust justice system supported by strong ngo checks and balances to do much about it. Corruption is the real infection of mankind - without it poverty eradication, health for all, education for all, basic needs for all etc would be more readily progressed.

 

That selectivity and privilege are pillars helping to support that corruption. 

 

Sadly, corruption seems to be back on the rise in the so called developed first world countries too.

This is one big mess, from the legal point of view.

Application of a criminal law retroactively is unheard of in the civilized world

Application of a law before it come into force...?

But no legal remedy against the seizure of all her assets?

All this smells like a whole lot of rats.

But the Military government really doesn't care about the Rule of Law. Shame!

Corruption on the rise in so called developed countries.

 

Please tell us more about that if you can.

 

Corruption is part of everyday life in most countries but on a very small scale and get caught you go down no matter who you are or how much money you have. Religion and money are the two evils of life and always have been. Here its on the rise, and even the poor are being ripped off and stolen from as we see in other stories on TV today.

 

The performance of late with the lies that accompany it, send out a message to the world that business and life in this neck of the woods is not worth the risk.

 

Looking around the country today how much of it is under water due to no implementation of preventive flood work? The money spent on other things like boys toys.

 

With the rise of lawlessness its not even worth risking a holiday here anymore for many. In time the Chinese will stop coming just like many other country's that now have warnings on their travel websites about the place.

 

Sad to say its now a place to avoid although TAT try to spin rubbish telling us Brits are coming but UK official figures say it dropped 50% in the last two years.

 

Those in charge cannot see the damage they are doing to this country, but they will in a few years that is for sure.

 

Most people who read the British Government travel website for here would not even think of coming on holiday or even retiring here. Time is nearly up I am afraid.
