Perhaps someone here has experiance with this. Both myself and my fiance are HIV +,(no tears please) :o She goes to the US embassy next week for her interview and blood test. Since HIV is an automatic denial, has anyone had experiance with where they do the blood test, Can the doctor be bought to say her blood in ok, and does any one have experiance with appealing a denial.

I have a good job in the USA over 60K annually, have full heath insureance for me and my spoice paid for by the company. We have been together for over 2 years.

Any help would be great

I would advise getting married first and then apply for a waver per below. If you try to get around the blood test you are putting everything at risk as any false statements on her visa applications can come back to bite at any time. It sounds as if you would have no problem with your job/insurance in place.

What happens if I test positive for HIV?

In the case of testing positive for the HIV virus, you must file a waiver application according to the above instructions. You must also show that your admission to the U.S.:

Poses minimal public health danger

Holds minimal possibility of spread of infection

Will not incur costs to any government agency without prior consent from that agency.

Note: Individuals seeking admission as refugees from outside the United States are not required to submit documentation of individual eligibility for HIV treatment or health care coverage with Form I-602. They are already considered to have the required consent based on their eligibility for Federally funded programs and the assurances provided to USCIS by HHS.
