Hi all, we'll be applying for my wife's Uk settlement visa in 4 weeks and are using an agent who insists that a p60 is a mandatory requirement. I started my current employment on the 28th April this year, so I'll have 6 months pay slips, bank statements (joint account at Bangkok bank where my salary is paid every week) employers letter confirming pay, length of employment & type (permanent, full time) plus all other required evidence, except a p60 as I wasn't employed at the end of the last tax year (i took 2 years off work so don't have a recent p45 either) I meet the financial requirement earning approximately 28000 p/a. Can anyone please advise whether a p60 is a required document and if it is not supplied can it lead to a refusal? My employer, being very helpful has said they can supply me with a statement of earnings for the past 6 months, would this suffice if a p60 is required? I have read the government guidelines FMSE and to me, it reads as if  a p60 is not mandatory but i have also read posts (on other forums and not current) where failure to provide a p60 has resulted in a refusal (although possibly this was not the only reason). Reading the following link a P60 is not mandatory and I would question your use of an agent who insists that it is.

Here is what it says:

 

What proof you need to give

You’ll need to send proof of your income with your application. If you or your partner are employed, you could include:

  • bank statements showing you or your partner’s income
  • 6 months of payslips
  • a letter from an employer, dated and on headed paper

The employer’s letter should confirm:

  • you or your partner are employed there
  • the job title or position you or your partner hold
  • how long you or your partner have worked there
  • the type of contract (for example, permanent, fixed term)
  • what you or your partner earn before tax and National Insurance
  • how long you or your partner have been paid your current salary
  • the payslips are genuine

Nothing in there about a P60.

 

I wouldn’t trust an explained visa refusal without seeing the refusal notice. Too many people gloss over the reasons a visa has been refused and have selective memories when telling others about their bad experiences.

 

I used my self employment accounts for my wife SV back in 2016 so I can't help on the finer points of being employed. For it I specifically needed an SA302 which showed that accounts had been submitted and tax had been paid.

2A. (i) In respect of salaried employment in the UK (paragraph 2 of this Appendix), statutory or contractual maternity, paternity, adoption or sick pay in the UK (paragraph 5 or 6 of this Appendix), or a director’s salary paid to a self-employed person (paragraph 9 of this Appendix), the applicant may, in addition to the payslips and personal bank statements required under that paragraph, submit the P60 for the relevant period(s) of employment relied upon (if issued). If they do not, the Entry Clearance Officer or Secretary of State may grant the application if otherwise satisfied that the requirements of this Appendix relating to that employment are met. The Entry Clearance Officer or Secretary of State may request that the applicant submit the document(s) in accordance with paragraph D of this Appendix.

As the previous two posters have advised, a P60 isn't required, your "agent" is wrong, it's a pity you've decided to use this agent.

 

As member Tanoshi rightly points out, the advice from the UKVI is that the applicant may submit a P60 in addition to the required evidence.

Unless the agent is OISC accredited, don't use them.

 

Even better, do it all yourself. It's not that hard and members on here who have been through it before are happy to help.

 

If you have ever applied for a visit visa for your wife before, you will already have 70-80% of the information that you need.
