Legal Advice Needed About Smoking

How do I launch legal proceedings against a cigarello/cigar smoker in our Condo who keeps all his doors and windows open, effectively polluting the entire floor? I have approached him personally in a Polite manner and was dismissed. I am also writing to the Condo Juristic, who won’t declare the building Non Smoking. I would appreciate any advice, practical experience or reasonable suggestions, especially where to go for legal advice or assistance. Unfortunately the new “passive smoking laws” only apply to houses and when they affect children. Thank you.

He's not breaking any laws or condo bylaws so you're going to have to go "public nuisance" which is going to need the support of other condo dwellers. Have you gathered opinion from your other neighbours?

 

A thought, rather than trying for a non-smoking building, how about a condo rule that requires all unit doors to be closed at all times (for fire safety reasons)?

Smokers, certainly in this day and age when people SHOULD know better, tend to be the most selfish and least empathetic people I've ever encountered. They have no self-awareness about how disgusting they are and they couldn't care less what other people think about them. Smoking is more a symptom of their ugly personality, not the cause of it. Someday they'll be slowly dying from cancer on a respirator somewhere, so that's about the only positive thing I could say about smokers.

 

Wait for this guy to die or just move yourself, you'll never convince this person to change his ways, and you'll just waste your time in court.

'Speaking to Manager Online, Dr Ronachai Khongsakon from a tobacco research group, says that women were particularly vulnerable with 81% suffering second hand smoke in their homes. He claims that 430,000 people die worldwide annually from second hand smoke, and that two out of three of the victims are women.

The ‘Report a Smoker’ hotline is 1300. Cases may then be referred to juvenile and other courts. The government says the move is the latest measure to stop people smoking in Thailand in public places, and now in their homes in the presence of other people.'

 

Surely this law must apply to shared buildings as secondary smoke is not restricted to the smokers room?

 

I enjoy sitting out on my terrace at my condo for coffee/breakfast, enjoying the clean air at this time of year- until the person below lights up. Then I have to retreat indoors.

 

I suggest check this out via google and discuss again with your JP. Personally I believe all condos should be smoke free

My right to clean air is just as viable as their right to smoke. But my right to clean air is affected by their smoking, not the other way around. My clean air does NOT jeopardize their health. Their smoking jeopardizes mine.

 

Some smokers seem to think that it is their God-given right to force others to inhale their second-hand smoke. That the non-smokers have no rights at all. Unfortunately, tobacco is money-making, so it will be a cold day in Hell before it's completely outlawed. Fortunately, many governments are now prohibiting smoking not just inside public buildings, but on major public streets in many cities. It's a step in the right direction.

I found it easier to live in a condo development with more considerate people.

Considerate people don't need rules. Inconsiderate people will break the rules. We've seen that demonstrated time and time again here.

Addicts are by nature irrational. No discussion with anyone of them will bring the result you want.

They only want the next fix without interference. 

Get used to it.

I asked him politely not to smoke inside his condo but he refused. Sometimes, I would wake up at 3 am in the morning after smelling his smoke.

So I just moved out and never rent that place again.

 

It's better to rent a big landed house than a condo which you can't control the smoking situation and the condo space is very small.

 

BTW, Koreans are notorious smokers.

Oh, perhaps you also mean the way a farang or a thai walks down the street and then casually just tosses their butt down on the ground for example, in total disregard for the environment

Why? are butts more damaging than plastic bags or all the rest of the rubbish being dumped all over the place?

Most Non-Smokers don't mind sitting on a busy street corner "people watching" every day. 500 cars passing by per hour? And enjoying the healthy "Burning-Season" in Chiang Mai every year?
Those have ended up in the wrong corner of paradise. In Europe most smokers have been burnt at the stakes in the meantime. Non-Smokers paradise! Chiang Mai Non-Smokers should urgently relocate back to Europe in order to find true paradise.


As long as they are willing to leave their SUV's in the garage, that is.

Big condo in CM, Sritana 2, has posters on every wall, every lift, every hallway:

NO SMOKING IN COMMON AREAS OR IN PRIVATE ROOMS. 

 

Can recommend that folks who do not want nearby smokers go to that condo or look for similar.  The management is 100% behind the NO SMOKING rule.

You obviously don’t have a clue how bad smokers stink. Non smokers can smell you on the street when you walk past. It lingers in your clothes and hair. It stains your teeth. It ages you. It’s deep in your breath and everyone can smell it when you cough or breath heavily. The stench is terrible and it seeps from your pores when you sweat.

 

Even worse, it shows how poorly someone takes care of themselves and how they don’t care about their own health. Lighting up these days says a lot about a person.

 

There’s a reason it’s being banned all over the world. But hey, smoke up!  I might hate your stench but I don’t have to live with the smoking related illnesses and cancer you’ll probably have to deal with. Excellent life choice. It ranks right up there with marrying a prostitute from a third world country.

Smokers (especially farangs) in Thailand seem to love smoking near kids - best idea, hire a woman with a kid to sit in reception, the smoker will be drawn to smoke as near to them as possible and end your problem
