HIV sufferers who donate blood can be charged with murder, says police spokesman

The deputy police spokesman said yesterday that anyone who knows they are HIV positive and who donates blood can be charged with murder in the event someone dies. 

 

Pol Col Krissada Pattanacharoen speaking at RTP HQ also said that inviting others to donate blood knowing that it is infected will fall foul of computer crime legislation. 

 

People who have tested positive for HIV are unable to give blood and stiff penalties exist throughout the world, notes Thaivisa. 

 

Daily News said there was a case in the news but gave no precise details as to what this was.

I wonder if people who are COVID-19 asymptomatic and donate blood are similarly liable?

 

Looping in a potential computer crime for soliciting blood donations on line seems like a slippery slope.

 

Blood donations will dry up.

To add a little science to the discussion, I had thought that the HIV scare was somewhat over, given the ready availability of retrovirals that lack side-effects and also drive down the level of infection so that it is no longer discernible in the blood in tests and the individual is no longer infectious.

 

So presumably what is being discussed here are the rather small number of individuals who are HIV positive, who have been tested and know that they are positive and have not started or been on retrovirals long enough for them to have effect.

Nope, my pal died of HIV last summer, after being treated in a specialist London hospital for a year.

No, they don't. I've given blood at the Red Cross here more than 20 times and have never been asked to pay anything or to undergo any tests other than the ones that are done at the Blood Center as part of the donation process.

A comment made by a Police Officer who is NOT a Doctor, all blood donated is checked in any event , if that person's blood is shown to have problems, they should be contacted for a follow-up with a doctor in relation to the anomaly, therefore if any person contacts HIV from a Blood donation it is thje Hospital and the Blood collector that should be in the frame for NOT CHECKING

But do they keep your records on file attached to that single blood donation, then if & when your blood is used in the future and someone subsequently dies you can then be traced and be charged for murder.

But the hospital is not liable for not screening it before use?

Not sure how that will work out in a court of law...?

The blood is tested after collection before it is administered to a patient...or even for that matter distributed to a hospital.

 

Blood donation/collection is centralized under the Thai red Cross.

Which is what I would thin happens of course...

But to say anyone with HIV donating blood can be held liable for murder is a ridiculous statement to make.

He must have had severe other issues, unable to take the medicine, not taking the medicine or  caught incredibly late as I know many consultants in this field and deaths now in UK of HIV are not common. People on medication and keeping to it and whose body does not become intolerant of medication or have the hiv mutate on them have the same  - if not longer - lifespans ahead of them. I say longer since with check ups every 6-9 months all other issues are found and addressed early before they become a problem

They want the blood of recovered Covid19 persons for scientific testing for development of possible vaccines and treatments.

Quite correct, and generally when on combo therapy, have better monitoring of blood glucose levels, kidney and liver function, cardiac monitoring and control of other health matters.

People who are "undetectable" and stable on therapy are less likely to also pass on other sexually transmissible infections due to monitoring of sexual health. 

This day and age to use the "sufferer" is also incorrect, as if stabilised , they are "living" with HIV, not "suffering" as in pre-combination therapy days.

Absolutely. And eqyually ridiculous to give it any publicity.
