Overstay( before the amnesty) on way to airport: can check in for one night in an hotel, around 1 pm? Thanks

  • I would not want to do anything on that long an overstay that could trigger police action prior to airport.  Might it be possible to pay for private travel to arrive directly to airport a bit before c

before the first Amnesty ? you need to provide more details then that.

If I write it's for a friensd of mine I suppose noone will believe. But yes, he is on 2 months os before the first amnesty. But please focus on the question, thank you.

Your question is a little vague: 

 

Your ‘friend’ was on a 2 month overstay prior to the Amnesty being announce. Thus, he could be classified as being an ‘over stayer’ and face risk for overstay penalties. 

 

Is your question regarding whether or not a hotel will alert authorities of his overstay thus placing your ‘friend’ at risk of arrest and greater consequences than simply self reporting at the airport ???

I dont think that anyone could answer with any certainty , the hotel should send your PP details to immigration  and they may notice the overstay and come and arrest you................or they might not .

  Its a risk that I would avoid taking

Either stay at some "resort" where passport details aren't checked or arrive directly at airport

Don't risk it, if he gets picked up before the airport it will be much worse. He may need to pay the fine + possible ban as it is now.

The key is for him to check in for his flight,  get to immigration and sort out his status, pay the fine and depart, without being apprehended. He should definitely not risk checking into a hotel with an expired visa in his passport. Your friend should do everything he can to make a private arrangement for the night before departure, or travel from where he is already staying direct to the airport.

There is always a risk for him to be caught, whether it is at the hotel or walking down the street. 

 

Thus: Checking in at the hotel presents a risk that Immigration is alerted. Whether Immigration choose to respond to any alert in a timely manner is a complete unknown. 

 

The only known factor is that your ‘friend’ is potentially placing themselves at greater risk by potentially involving ‘other people’ in the knowledge of his overstay. 

 

One poster has recommended - Find a place which allows 'your friend' to stay without having to present his passport.

yes there is some risk.  I advise against it. Go straight to the airport. There is a hotel inside the departure area if he needs it.

Check in at some "love hotel", they won't ask for a passport.

Are you sure he is on overstay and not covered by the amnesty? Most people are. When did his permission to stay end and what type of visa does he have?

Two posts say os was prior to amnesty (two months prior).

Sorry, missed that. While it might be fine there is some risk and if I were this person I would not take the chance. Go straight to the airport.

Whats the time penalty for 9 months overstay ??  Year ban or longer (mind you hardly will matter for next 2-3 years !)

If he don't have that 20k thats more big problem!!!! Coz he can't leave before pay fine! And they take him arrest center. Then have more big problem than think how long ban going to get. He get 1 year ban if less than year overstay! If they caught him outside airport he can get 5 year ban.

Actually this used to be true. Straight in and close the curtains. However, I've not used one since Covid so they may be a lot more careful now , especially where foreigners are concerned.

It's up to the hotel, they may not even let him check in with no visa.

Only the fine as long as he is not arrested before he gets to the airport to pay.  If he's paying the overstay at the airport as he's leaving he will not be banned.
