The Law on Vietnam Coast Guard took effect on July 1, 2019, an important milestone in the process of perfecting Vietnam's legal system on sea and islands.

The Law on Vietnam Coast Guard creates a legal corridor to protect the sovereignty of sea and islands

 

The introduction of the Vietnam Coast Guard Law has important implications for the Coast Guard in the process of performing its functions and duties, maintaining law enforcement as well as protecting national sovereignty and jurisdiction at sea.

 

The Law defines: “The Vietnam Coast Guard is the people's armed force, a specialized force of the Government, serving as the core of law enforcement and protection of national security, order and safety at sea. The Vietnam Coast Guard has the function of advising the Minister of National Defense to promulgate according to its competence or propose to the Party and the Government on policies and laws to protect national security, order and safety at sea; protect the sovereignty and jurisdiction of the country in the waters of Vietnam; manage security, order, safety and ensure the observance of Vietnamese laws, international treaties to which the Socialist Republic of Vietnam is a signatory, international agreements within its competence” (defined in Article 3/Vietnam Coast Guard Law 2018).

 

Talking about the importance and significance of the Vietnam Coast Guard Law, Major General Tran Van Nam, deputy commander of the Vietnam Coast Guard said: The Law on Coast Guard of Vietnam was born with very important meaning for the Coast Guard in the process of organizing the performance of functions and duties, maintaining law enforcement at sea, as well as protecting national sovereignty and jurisdiction.

 

The law is the highest legal corridor for the Vietnam Coast Guard to well perform its assigned functions, tasks, and authority.

"The Vietnam Coast Guard Law concretizes the views and policies of the Party and the Government of Vietnam in the protection of sovereign rights and national jurisdiction by legal, civil and peaceful measures. Thereby, the Law aims to build Vietnam's sea, an international sea of peace, cooperation, and development,” said Major General Tran Van Nam.

 

Tran Van Nam said that since the Law on Coast Guard was born, the Coast Guard has well organized the contents according to the provisions of the Law. In particular, the force has promoted the Law to the people and fishermen, so that all classes of people understand, firmly grasp, and strictly abide by the provisions of the Law. After that, the people cooperated well with the Coast Guard to prevent crime and violations; maintain security, order and safety at sea and protect Vietnam's sovereignty over seas and islands by lawful and peaceful measures.

 

In addition, the Law has strict regulations on organization and assurance of activities, regimes, and policies. The Vietnam Coast Guard Law also creates a solid legal basis for the construction of the Coast Guard. The Vietnam Coast Guard is given priority in terms of resources, investment in infrastructure, ships, vehicles, and technical equipment to build up to modernity in the coming time.
